THE CITY OF 2 <br /> CITY COUNCIL AGENDA REPORT <br /> L£ASANTON <br /> October 5, 2021 <br /> City Attorney <br /> City Clerk <br /> City Manager <br /> TITLE: CONSIDER APPROVAL OF A RESOLUTION ADOPTING FINDINGS <br /> REGARDING SOCIAL DISTANCING AND PUBLIC HEALTH ARISING <br /> FROM THE COVID-19 PANDEMIC WHICH SUPPORT THE CONTINUATION <br /> OF VIRTUAL PUBLIC CITY MEETINGS <br /> SUMMARY <br /> The State's opening meeting law, the Brown Act, generally requires that the City <br /> Council, commissions and committees hold open and public meetings within the City <br /> limits, and where members of the public may attend and participate. Due to the COVID- <br /> 19 pandemic, the Governor declared a state of emergency and suspended some Brown <br /> Act requirements, allowing for virtual meetings to protect the public health. New State <br /> law, AB 361, requires that the City make findings regarding public health and social <br /> distancing in order to continue with virtual meetings. The City Council needs to adopt <br /> such findings (and renew them every 30 days) as: (1) the City Council, while meeting in <br /> person, allows participants to join on-line; (2) Council subcommittees are meeting <br /> virtually; and (3) City commissions and committees are meeting virtually because their <br /> larger membership does not allow for social distancing in their meeting rooms. <br /> RECOMMENDATION <br /> Approve resolution adopting findings regarding social distancing and public health <br /> arising from the COVID-19 pandemic which support the continuation of virtual public <br /> City meetings. <br /> FINANCIAL STATEMENT <br /> No affect. Existing staff will continue to facilitate meetings. <br />
