PUBLIC NOTICE <br />Notice of this application was sent to property owners and tenants subject to the <br />AGFUO, and to parties who provided comments on this topic to -date. Direct outreach <br />was also made to the PDA and Chamber of Commerce. Written comments received as <br />of the publication of this agenda report, including comments received in advance of the <br />Planning Commission hearing, are included as Attachment 4. Any additional <br />correspondence, including that from the PDA or Chamber of Commerce, will be <br />provided to the City Council upon receipt by staff. <br />CONCLUSION AND RECOMMENDATION <br />The proposed amendments to the DSP and PMC will clarify policies and text related to <br />the AGFUO and implement City Council's direction provided on June 1 and incorporate <br />Planning Commission's recommendations provided on July 28. Therefore, staff <br />recommends the City Council adopt the proposed amendments as recommended by <br />the Planning Commission. <br />Alternatively, the City Council could adopt the DSP and PMC amendments as were <br />originally recommended by staff to the Planning Commission (reference the Planning <br />Commission report included in Attachment 3). In addition to clarifying changes, these <br />amendments indicated: a 60% active use requirement in tenant spaces with more than <br />one use (measured as minimum tenant space depth and as a percentage of the total <br />square footage of the tenant space); a requirement that each use in a tenant space with <br />multiple uses be required to obtain its own business license; and a requirement that in <br />spaces where there is an active and non-active use in a single tenant space, signage <br />for the active use be emphasized such that any signage for the non-active use is clearly <br />subordinate. <br />Iub iced y� <br />J <br />It Glark <br />Director of Community Development <br />Approved by: <br />Nelson Fialho <br />City Manager <br />Attachments: <br />1.
