Please note that the Transportation Corridor and Fire Station 3 are currently under <br /> construction. Please reference Attachment IV for the planting plans for the <br /> Transportation Corridor and Fire Station 3. <br /> The Contractor shall not be held responsible for plant losses due to maladies beyond the <br /> Contractor's control; this includes, but is not limited to, disease or insect attack for which <br /> there is no legal recommended control, acts of large-scale vandalism (over$200 in <br /> materials), earthquakes, fires, unusual storms, and related events. Report all such <br /> conditions to the City in writing and submit a proposal for the repair of the work. Obtain <br /> the City's approval prior to proceeding with the work affected. All acts of vandalism <br /> exceeding $200 require a Public Safety report and a copy of this report must be provided <br /> to the City along with the repair estimate. <br /> 1-02 Replacement of Plants <br /> The Contractor shall remove dead and irreparably damaged lawn, groundcover,trees, <br /> shrubs, or other plant material and replace when such death or damage is through normal <br /> attrition, or due to vandalism. The City may request that plants be replaced by the <br /> Contractor under"Additional Cost Work"as approved by the City. The Contractor shall <br /> remove dead damaged lawn, groundcover,trees, shrubs, or other plant material and <br /> replace it at their own expense when such death or damage is due to Contractor's failure <br /> to provide maintenance in accordance with the provisions herein, incorrect pesticide <br /> application/spray drift, or due to insect or disease infestations that could/should have <br /> been controlled by the Contractor in the sole opinion of the City. Contractor shall remove <br /> and replace such plant material within two weeks of notification by the City. Plants shall <br /> be replaced with material of equivalent size and variety to material being removed unless <br /> other material is approved by the City. All replacement material shall be approved by the <br /> City before installation by the Contractor. <br /> 1-03 Work Not Included <br /> A. Repairs or replacement of losses and damages not covered by the contract, except <br /> as noted. <br /> B. New planting and other special services, except with City's request or approval in <br /> writing and agreement to pay. <br /> C. Maintenance of irrigation systems. <br /> D. Major vandalism with material costs of over $100 or damaged caused by natural <br /> disasters. <br /> SECTION 2. SPECIAL CONSIDERATIONS <br /> 2-01 Special Considerations <br /> A.
