Attachment 1 <br /> THIRD AMENDMENT TO AGREEMENT <br /> This Third Amendment to Agreement 2019343 ("Third Amendment") is entered into this 21' <br /> day of September 2021 by the City of Pleasanton("City") and SCI Consulting Group <br /> ("Consultant") <br /> Whereas, on December 21, 2018,the City and Consultant entered into a Professional Services <br /> Agreement for financial and engineering services for the city-maintained lighting and landscape <br /> maintenance districts(the"Agreement"); and <br /> Whereas,the parties entered into a First Amendment on September 3, 2019, Proposition <br /> 218 balloting services for the Windsor and Bonde Ranch landscape maintenance districts and to <br /> provide updated Engineer's reports for all five districts; <br /> Whereas, the parties entered into a Second Amendment on April 21, 2020,to remove the <br /> balloting services from the contract due to the pandemic; <br /> Whereas, the parties desire to amend the Agreement for a change to the scope of work. <br /> Now, therefore, in exchange for valuable consideration,the receipt of which is hereby <br /> acknowledged the parties agree as follows: <br /> 1. Section 1 of the Agreement, "Consultant's Services" is amended to reference the <br /> attached Exhibit A. <br /> 2. Section 3 of the Agreement, "Term" is extended to December 31, 2023. <br /> 3. Section 4 of the Agreement, "Compensation" is amended to read: <br /> For the professional services to be rendered, City shall pay Consultant on a time- and <br /> materials basis. Compensation shall be the amount set forth in and based on the rate <br /> schedule of Exhibit"A" which is attached and incorporated to this Agreement. The <br /> payments shall be made on a monthly basis upon receipt and approval of Consultant's <br /> invoice. Consultant shall receive additional compensation in the amount of$54,695 <br /> for a total contract amount of$108,065. <br /> 4.
