THE CITY OF 8 <br /> CITY COUNCIL AGENDA REPORT <br /> pLE ASANTON. <br /> September 21, 2021 <br /> Engineering Department <br /> TITLE: APPROVE THE THIRD AMENDMENT TO THE PROFESSIONAL <br /> SERVICES AGREEMENT WITH SCI CONSULTING GROUP FOR <br /> ADDITIONAL FINANCIAL AND ENGINEERING SERVICES FOR A NOT- <br /> TO-EXCEED AMOUNT OF $54,695 FOR A TOTAL CONTRACT AMOUNT <br /> OF $108,065 FOR THE LIGHTING AND LANDSCAPE MAINTENANCE <br /> DISTRICTS <br /> SUMMARY <br /> The City of Pleasanton manages five Lighting and Landscape Maintenance Districts <br /> (LMDs) that were formed in the 1980s and 1990s (Ponderosa-Del Prado, Windsor, <br /> Bonde Ranch, Oak Tree Farm, and Moller Ranch). Assessments have not increased <br /> since the formation of the LMDs as no vote to modify the fees has occurred since the <br /> passage of Proposition 218, which required a majority vote by homeowners to change <br /> the assessment. All five LMDs are now underfunded. <br /> In December 2018, the City authorized SCI Consulting Group (SCI) to review and update <br /> the Engineer's Reports for the five LMDs for Proposition 218 compliance. The proposed <br /> third amendment to the professional services agreement with SCI is to prepare the <br /> 2022/23 Engineer's Reports and to re-start the efforts to address the funding shortfalls, <br /> which were ceased due to the pandemic, of the two LMDs with the greatest funding <br /> challenges — Windsor and Bonde Ranch. SCI, in conjunction with City staff, will update <br /> the Engineer's Reports for all five LMDs and work towards a Proposition 218 compliant <br /> vote regarding an assessment increase for Windsor and Bonde Ranch based on an <br /> analysis of the LMDs and the input received during the public outreach process. <br /> RECOMMENDATION <br /> 1. Authorize the City Manager to execute the third amendment to the professional <br /> services agreement with SCI in the amount of$54,695 for a total contract amount of <br /> $108,065 and to extend the agreement through December 31, 2023. <br /> 2. Authorize expenditures of $54,695 from the General Engineering - Professional <br /> Services budget to cover the cost of the amendment. <br /> FINANCIAL STATEMENT <br /> Funds are budgeted for this purpose in the FY 21/22 Engineering Operating Budget. <br />
