In concert, Section 9.30.100 <br /> (Excess Use Penalties) was adapted to include the two new stages with a pattern of <br /> escalation based on the previously approved penalty scaling. <br /> Staff will bring forward a water supply update at an upcoming City Council meeting, <br /> which may include recommendations on the declaration of a water shortage level based <br /> upon Zone 7's actions at their September 1, 2021 meeting to discuss current water <br /> supply. <br /> Other Proposed Amendments <br /> Section 9.30.010 — Modification made in accordance with California Water Code (CWC) <br /> Section Division 1, Section 350, specifying the water supplier's "governing body" as the <br /> authorized authority to declare a water shortage emergency. <br /> Section 9.30.060 — In addition to the WSCP six stage framework, language has been <br /> incorporated to specify City Council's authority to enact Water Drought Rates as <br /> specified in PMC 14.04.070 and the Master Fee Schedule. <br /> Section 9.30.070 —Add the citation of CWC section requiring water suppliers to have <br /> the authority to penalize or charge for excessive water use. <br /> Section 9.30.080.A.2 —Adjusted the window of regular overhead irrigation to fall <br /> between the hours of 9 p.m. and 6 a.m. from the previous 6 p.m. to 9 a.m. to match <br /> neighboring Tri-Valley water agencies. In addition, this window is better for reduced <br /> water loss from wind and evaporation. <br /> Section 9.30.110.B.1 — Language added for clarification to allow for irrigation during <br /> otherwise prohibited hours for irrigation system checks and maintenance. <br /> Section 9.30.110.B.9—Added prohibited use of potable water as defined under PMC <br /> 14.04.060.G.7 (potable water for irrigation within recycled water use area), which was <br /> added to the PMC in February 2018. <br /> Section 9.30.120.B — Language added for clarification to assist in the understanding of <br /> what customer payment(s) are due when a customer undergoes the excess use <br /> adjustment process. <br /> Section 9.30.120.E.1 — Language added for clarification of when payment is due after <br /> the denial of an excess use adjustment appeal. <br /> A redline version of the proposed changes to PMC Chapter 9.30 is attached <br /> (Attachment 1). <br /> Page 3 of 4 <br />
