Attachment 3 <br /> Recording Requested By: <br /> CITY OF PLEASANTON <br /> And When Recorded Mail to: <br /> City of Pleasanton <br /> P.O.Box 520 <br /> Pleasanton,CA 94566 <br /> Attention: City Clerk <br /> Exempt from Recording Fees per Government Code <br /> §27383 and from Documentary Transfer Tax per Revenue <br /> and Taxation Code§11922 <br /> Space Above This Line for Recorder's Use <br /> APN 941-1300-002-08 <br /> GRANT OF EASEMENT <br /> THIS GRANT OF EASEMENT is made and entered into this 18th day of May, 2021 by and <br /> between Dublin San Ramon Services District ("Grantor") and the City of Pleasanton <br /> ("Grantee"). <br /> For valuable consideration, receipt of which is acknowledged, Grantor grants to Grantee a <br /> permanent easement and right of way for roadway, underground utilities, sidewalk and <br /> landscaping purposes, including the right to construct, replace, inspect, maintain, repair, operate <br /> or remove a roadway, supporting columns, walls and footings, underground utilities, sidewalks, <br /> pathways, landscaping including any and all appurtenances thereto, over, under, upon and across <br /> the following described real property situated in the City of Pleasanton, County of Alameda, State <br /> of California, described in Exhibit "A" and depicted in Exhibit "B," which Exhibits are attached <br /> hereto and made a part hereof. <br /> Grantee hereby acknowledges the title of Grantor in and to the property underlying the property <br /> described in Exhibit "A" and depicted in Exhibit "B" hereto, and agrees never to assail or to <br /> resist said title. If Grantor determines in its sole discretion that it is required to relocate its <br /> facilities installed from time to time within the underlying the property described in Exhibit "A" <br /> and depicted in Exhibit "B" hereto because of changes to the roadway made by, on behalf of, <br /> or as permitted by, Grantee, Grantee shall reimburse Grantor for all costs and expenses <br /> reasonably incurred by Grantee to relocate Grantee's facilities. <br /> The Grantor reserves the right to use the easement parcel for existing and future underground <br /> utilities, including without limitation sanitary sewer lines, potable water lines, recycled water <br /> lines, and all appurtenances thereto, including the right to install, construct, reconstruct, repair, <br /> maintain, and operate such facilities, and for all other purposes not inconsistent with the <br /> easement. However, such use by the Grantor shall not include the construction of permanent <br /> above-ground structures, including but not limited to buildings, retaining walls, decks, patios, <br /> or other concrete structures within the easement. Nothing in the foregoing or elsewhere in this <br /> easement shall be construed to prevent or restrict'Grantor from placing or permitting to be <br /> Page 1 of 3 <br />
