August 2019 Adopted DSP <br /> While the concept of the AGFUO was discussed during the 2002 update to the DSP <br /> (and at that time, not included as a policy), it was adopted with the most recent 2019 <br /> update. The general premise in requiring active uses along Main Street is to encourage <br /> pedestrian activity downtown and enliven downtown with more shoppers and business <br /> patrons, and by increasing activity improve the economic vitality of downtown. <br /> The adopted DSP includes the below definition and policies related to active ground <br /> floor uses; the definition and policies have been carried forward to the Pleasanton <br /> Municipal Code (PMC), excepted as Attachment 1 to this report. <br /> Active Ground Floor Use Definition <br /> "Active ground floor use"in the DSP is defined as, "a use that promotes an active <br /> pedestrian environment on the ground floor of a commercial building, and <br /> includes retail establishments, restaurants, bars and brew pubs, art and crafts <br /> studios, and other uses determined by the director of community development to <br /> be substantially similar to the foregoing, or to have unique characteristics such <br /> that the objectives of the overlay district would be met." <br /> DSP Policies <br /> LD-P. 17, Active Ground Floor Use Requirements for Multi-Tenant Buildings <br /> "For buildings that have multiple tenant spaces, apply the requirements of the <br /> Active Ground Floor Use Overlay to tenant spaces with frontage on Main Street, <br /> and certain streets within portions of the Mixed-Use-Downtown District <br /> "designated active streets."Exceptions to this requirement may be granted in <br /> accordance with LD-P.19." <br /> LD-P.18, Active Ground Floor Use Requirements for Multi-Use Spaces <br /> "For tenant spaces accommodating multiple uses, a minimum of the first 25 <br /> percent of the depth of tenant space (measured perpendicular to the façade <br /> fronting a designated active street) must be occupied with an active use. <br /> Exceptions to this requirement may be granted, in accordance with LD-P.19." <br /> LD-P.19, Exceptions to the Active Ground Floor Use Requirement <br /> "The director of community development may grant an exception to the <br /> requirements of the Active Ground Floor Use Overlay district for uses meeting <br /> any of the following criteria: <br /> • The tenant space has been vacant for a period of at least 6 months. <br /> Evidence of attempts to lease space shall be provided to the director of <br /> community development upon request. <br /> • The configuration of the tenant space is such that it would have a <br /> storefront frontage of less than 10 feet (as determined by the director of <br /> community development) on a designated active street. <br /> • The tenant is located in an existing, purpose-built building containing a <br /> bank or financial institution as its primary tenant/occupant. <br /> 3 <br /> Exhibit B to July 28 Planning Commission agenda report <br />e City Council for discussion and direction regarding the policies in the August <br /> 2019 DSP regarding active ground floor uses. <br /> 2 The AGFUO would also apply to the Mixed-Use Downtown District.
