<br />30 <br />are reimbursed to Members and deficits cause an additional cash payment to LAVWMA by the <br />Members. See “SECURITY FOR THE 2021 BONDS - Sewer Service Contract.” <br /> <br />The 2021 Bonds are a Limited Obligation of LAVWMA. The 2021 Bonds are special, <br />limited obligations of LAVWMA, and are only secured by a pledge of the portion of LAVWMA Net <br />Revenues that is required to pay principal or Redemption Price of and interest on the 2021 Bonds. <br />LAVWMA’s obligation to pay debt service on the 2021 Bonds is limited to the extent that it receives <br />the Fixed Cost Allocation for Debt Service component of the Payments from the Members and <br />that other Payments from the Members are sufficient to pay LAVWMA Maintenance and <br />Operation Costs; the Fixed Cost Allocation for Debt Service component of the Payments is sized <br />to be equal to the scheduled debt service on the 2021 Bonds (without any coverage). See, <br />however, “SECURITY FOR THE 2021 BONDS – Rate Stabilization Fund” for a discussion of other <br />moneys available to pay debt service on the 2021 Bonds. <br /> <br />Permits and Regulations <br /> <br />General. Livermore and DSRSD each separately own and operate wastewater treatment <br />facilities that discharge fully treated effluent to LAVWMA for pumping and disposal into San <br />Francisco Bay. Pleasanton discharges untreated sewage from its sanitary sewer collection <br />system to DSRSD for treatment and disposal under the terms of the Regional Agreement. During <br />wet weather events, LAVWMA is also permitted to discharge a portion of its flows to San Lorenzo <br />Creek and/or Alamo Creek. LAVWMA is not aware of any environmental or regulatory issues that <br />would adversely impact its ability to pump and properly dispose of wastewater effluent, or the <br />ability of its member entities to treat and properly convey treated wastewater to LAVWMA. <br /> <br />Permitting. LAVWMA’s NPDES permit regulating wet weather discharges was recently <br />approved for renewal effective July 1, 2021. LAVWMA’s new permit expires June 30, 2026. <br />Pleasanton has no related NPDES permit. Livermore and DSRSD recently applied to renew their <br />individual NPDES permits that regulate the operation of their respective wastewater treatment <br />facilities; neither agency requested any changes to their permit status (no changes in flow or <br />wastewater characteristics). The individual NPDES permits issued by the Bay Area Regional <br />Water Quality Control Board (“RWQCB”) expire on June 30, 2022. LAVWMA is not aware of any <br />environmental or regulatory issues that would adversely impact the ability of the Members to <br />obtain renewals of their individual discharge permits. <br /> <br />Capacity Rights. Livermore and DSRSD discharge to LAVWMA, and LAVWMA in turn <br />discharges to EBDA via the terms and conditions of the EBDA Agreement. The EBDA Agreement <br />provides for a total of 41.2 mgd of peak flow capacity for LAVWMA, which is further defined as <br />19.7 mgd of “firm” capacity, and 21.48 mgd of “interruptible” capacity. <br /> <br />The wet weather permit that the RWQCB granted to LAVWMA provides permitted points <br />of discharge into San Lorenzo Creek and Alamo Creek. The outfall into San Lorenzo Creek is <br />permitted during wet weather events when EBDA exercises its right to interrupt a portion of <br />LAVWMA’s discharge flow (i.e., the 21.48 mgd of “interruptible” capacity). The outfall into Alamo <br />Creek is permitted during prolonged wet weather events when all of LAVWMA’s on-site storage <br />capacity is filled. The NPDES permit anticipates a discharge to San Lorenzo Creek approximately <br />once every 1.5 years. There has never been a discharge to Alamo Canal, but the permit <br />anticipates discharges only during storm events of greater than 10-year frequency. The EBDA <br />Agreement expires on June 30, 2040, which coincides with the term of EBDA’s separate Joint <br />Exercise of Powers Agreement. However, the EBDA Agreement allows LAVWMA to continue <br />discharging to EBDA even after the EBDA Agreement expires, as long as LAVWMA continues to
