<br />29 <br />Service Area <br /> <br />LAVWMA provides wastewater disposal to a service area, which includes the wastewater <br />service areas of DSRSD, Pleasanton and Livermore. Under the Joint Powers Agreement, <br />Members may provide wastewater service only to those areas that now, or in the future, are <br />incorporated within the city limits of Livermore, Pleasanton, and Dublin. DSRSD may provide <br />service to the area within the city limits of San Ramon that DSRSD served as of September 10, <br />1997, and any area in the Specific Plan for Westside San Ramon (adopted in November 1989) <br />that is subsequently incorporated into the City of San Ramon. DSRSD may also provide service <br />to Camp Parks for governmental uses. Livermore may continue to provide service to the Ruby <br />Hill subdivision in Pleasanton. In addition, the Members may continue to serve unincorporated <br />areas currently served. Furthermore, Livermore may provide wastewater treatment and disposal <br />service to approved uses in the unincorporated Agricultural Enhancement/Rural Management <br />Zone (Zone B), which may be established within the planning area for the North Livermore <br />General Plan Amendment adopted by the Livermore City Council on October 11, 1993, and to <br />the Veterans Administration Hospital property for governmental uses. In the interest of public <br />health and safety, Members may also provide service to unincorporated properties adjoining a <br />city, unless the cumulative amount of proposed service in any one contiguous unincorporated <br />geographic area exceeds 10 residential connections or the equivalent, in which case such service <br />would require unanimous approval of the LAVWMA Board. Except as described above, no <br />Member may provide service to an unincorporated area of Alameda County south of Interstate <br />580 or to the planning area for the North Livermore General Plan Amendment (except for certain <br />minor exceptions) without unanimous vote of the LAVWMA Board. <br /> <br />LAVWMA Budget <br /> <br />General. Pursuant to the Joint Powers Agreement, each Member is required to provide <br />its share of LAVWMA’s annual operating budget including debt service and replacement, fixed <br />operating costs, and variable costs, with cash advances made on a quarterly basis. These <br />obligations are also provided for under the Sewer Service Contract. See “SECURITY FOR THE <br />2021 BONDS - Sewer Service Contract.” <br /> <br /> Debt service and replacement reserve accrual allocations are based on each <br />Member’s capacity rights in sole-use, dual-use, and joint-use facilities. <br /> <br /> Operating and maintenance costs are ongoing expenditures for repair, <br />replacement and other costs incurred upon completion of construction of facilities <br />so that the facility can continue to perform the function for which it was designed. <br /> <br /> Fixed operating costs are a function of the facilities constructed and allocations <br />are based on each Member’s joint-use PWWF capacity rights and include all <br />operation and maintenance costs except for variable costs. <br /> <br /> Variable operating costs are a function of actual flows discharged to LAVWMA <br />and include costs of chemicals and power. Variable costs are allocated to each <br />Member based on estimated flows. <br /> <br />At the end of each fiscal year and after approval of an audit, cash advances based on <br />estimates of the preceding year will be reconciled with actual costs and actual flows.
