<br />DRAFT June 15, 2021 | Page 28 <br />THE CITY OF PLEASANTON <br />SB 1383 ACTION PLAN <br />2021 ─ 2025 <br />3.3 Product Procurement <br /> <br />It is also recommended that the City explore the option of procuring electricity from biomass from East Bay <br />Community Energy. While this amount would likely not be enough on its own to fulfill the SB 1383 procurement <br />target, it would contribute toward the City’s target. <br />City staff has had preliminary meetings with StopWaste regarding procurement strategies. It is recommended that <br />the City continue its discussions with StopWaste regarding potential regional approaches to procurement that <br />would support the City in meeting its target. <br />The City is also required to procure recycled-content paper products and printing and writing paper derived from <br />recycled content in accordance with Sections 22150 through 22154 of the Public Contracts Code. These statutes <br />direct local governments to give preference to suppliers of recycled products when quality is equal to, or greater <br />than, non-recycled items and when cost is less than or equal to non-recycled items. Vendors will need to certify a <br />minimum percentage of post-consumer material in their offered products, among other requirements. <br />Documentation and records of purchases will need to be maintained in the City’s implementation record. <br />Finally, the City will need to develop an EPPP in order to successfully meet the program requirements. For further <br />information on the required changes, please reference Section 3.3.2 below. <br />3.3.2 State SB 1383 Requirements for Jurisdictions <br />• Commencing January 1, 2022, a jurisdiction shall annually procure a quantity of recovered organic waste <br />products that meets or exceeds its current annual recovered organic waste product procurement target as <br />determined by article 12 (§18993.1.a). <br />• Beginning on or before January 1, 2022 (and every five years thereafter) the annual recovered organic waste <br />product procurement target will be calculated based upon multiplying the per capita procurement target by <br />the jurisdiction population where (§18993.1.b): <br />o Per capita procurement target = 0.08 tons of organic waste per California resident per year <br />(§18993.1.b.1). <br />o Jurisdiction population equals the number of residents in a jurisdiction, using the most recent annual <br />data reported by the California Department of Finance (§18993.1.b.2). <br />• A jurisdiction shall comply with the product procurement target by directly procuring recovered organic waste <br />products for use or giveaway and/or requiring, through a written contract or agreement, that a direct service <br />provider to the jurisdiction procure recovered organic waste products and provide written documentation of <br />such procurement to the jurisdiction (§18993.1.e.1 and §18993.1.e.2). <br />• For the purposes of SB 1383 Article 12, the recovered organic waste products that a jurisdiction may procure <br />to comply with article 12 are (§18993.1.f): <br />o Compost from a compostable material handling operation, facility, or a large volume in-vessel digestion <br />facility. <br />o RNG used for fuel, electricity, or heating applications. <br />o Electricity from biomass conversion.
