<br /> <br />DRAFT – June 15, 2021 | Page 29 <br />THE CITY OF PLEASANTON <br />SB 1383 ACTION PLAN <br />2021 ─ 2025 <br />3.3 Product Procurement <br /> <br />o Mulch, provided that the jurisdiction is in compliance with land application requirements specified in 14 <br />CCR Section 17852(a)(24.5)(A) and the mulch is produced at a compostable material handling operation, <br />a transfer/processing facility, or a solid waste landfill. <br />• The following conversion factors shall be used to convert tonnage in the annual recovered organic waste <br />product procurement target for each jurisdiction to equivalent amounts of recovered organic waste products <br />(§18993.1.g). One ton of organic waste in a recovered organic waste procurement target shall constitute one <br />of the following: <br />o 21 diesel gallon equivalents, or “DGE,” of renewable gas in the form of transportation fuel. <br />o 242 kilowatt-hours of electricity derived from RNG. <br />o 22 therms for heating derived from RNG. <br />o 650 kilowatt-hours of electricity derived from biomass conversion. <br />o 0.58 tons of compost or 1.45 cubic yards of compost. <br />o One ton of mulch. <br />• RNG procured from a Publicly Owned Treatment Works (POTW) may only count toward a jurisdiction’s <br />recovered organic waste product procurement target provided the conditions outlined in SB 1383 Article 12 <br />are met for the applicable procurement compliance year (§18993.1.h). <br />• Electricity procured from a biomass conversion facility may only count toward a jurisdiction’s recovered <br />organic waste product procurement target if the biomass conversion facility receives feedstock directly from <br />a compostable material handling operation, a transfer/processing facility, or a solid waste landfill (§18993.1.i). <br />• Procure paper products, and printing and writing paper consistent with the requirements of Section 22150- <br />22154 of the Public Contracts Code. These paper products shall be eligible to be labeled with an unqualified <br />recyclable label as defined in 16 C.F.R. 260.12. Jurisdiction shall require all businesses that it purchases paper <br />products and printing/writing paper to certify minimum percentage of postconsumer material in the paper <br />products (§18993.3). <br />3.3.3 Ordinance and Policy Needs <br />It is recommended that the City, at a minimum, develop an EPPP to align with the requirements of SB 1383 <br />described above. Specifically, the City should add in language that will describe: (1) how recovered products will <br />be procured; (2) how interdepartmental purchasing of these products will be supported; (3) how records will be <br />maintained; and, (3) how it will commit to reaching the annual procurement target. <br />The updated EPPP will need to include procedures for paper purchases and post-procurement <br />tracking/monitoring. One way to track and monitor would be to acquire recycled paper content from a vendor’s <br />online purchasing portal, which can track purchases and aid in verification of compliance. The City should also <br />consider the resources available on the CalRecycle website which include an updated database of recycled- <br />content product manufacturers.1 <br /> <br />1 CalRecycle, Buy Recycled.
