Costs <br />The City will have one-time costs of approximately $40,000 to $50,000 for these <br />activities. There will be a minor increase in ongoing City staffing needs and costs <br />associated with collection and processing programs. Schedule <br />These activities must commence immediately, with some City requirements completed <br />by January 1, 2022, and other implementation activities extending through early 2022. <br />Provision of collection and processing services is a permanent, on-going requirement. <br />B. Monitoring and Enforcement <br />1. Requirements <br />SB 1383 requires that jurisdictions implement robust monitoring and enforcement <br />programs for all aspects of the regulations. The prescribed enforcement programs <br />include, but are not limited to: <br />• Contamination monitoring for prohibited container contaminants via route <br />reviews or waste evaluations; <br />• Desktop compliance reviews for certain commercial and multi-family <br />generators; <br />• Inspection of Tier 1 and Tier 2 Commercial Edible Food Generators and food <br />recovery organizations and services to ensure compliance with food recovery <br />requirements. Tier 1 inspections commence January 1, 2022; Tier 2 <br />inspections commence January 1, 2024; <br />• Investigate complaints received regarding non-compliant entities; <br />• Conduct re-verification inspections for waivers granted (if any); <br />• Beginning January 1, 2022, until December 31, 2023, a jurisdiction shall <br />provide education materials describing the applicable requirements of SB 1383 <br />in response to violations; and, <br />• Beginning January 1, 2024, enforcement of any violations of SB 1383 (excluding <br />prohibited container contaminants) by issuing Notices of Violations (NOVs) <br />and issuing penalties if violations are not corrected. Penalties range from $50 <br />to $500 per violation.
