<br />DRAFT June 15, 2021 | Page 5 <br /> <br />2.1 Overview <br />2.1.1 Action Plan Development <br />The City engaged HF&H to develop this Action Plan for the City’s implementation of SB <br />1383 regulations. The Action Plan focuses on seven essential programs (listed in Figure <br />1 and the column to the left). <br />2.1.2 Action Plan Overview <br />This Section provides a high-level overview of the Action Plan. Please refer to Section <br />3 for full details of the Action Plan by program area. <br />A. Collection and Processing <br />1. Requirements <br />SB 1383 compliance requires implementing mandatory residential and commercial <br />solid waste, recycling, and organics collection and processing programs. The City <br />currently has provisions for mandatory service for specific generators through the <br />Mandatory Recycling Ordinance (MRO); however, the provisions are not sufficient to <br />comply with SB 1383. SB 1383 does allow CalRecycle to grant certain jurisdiction <br />waivers for low population, high elevation, or rural areas, but the City does not qualify <br />for such waivers. The City may grant waivers for certain customers with de minimis <br />waste generation volumes and space constraints, but this is not required. <br />2. Key Activities <br />The City will have to amend its current Municipal Code to comply with SB 1383's <br />mandatory solid waste, organic waste (including food waste), and recyclables <br />collection services for all single-family, multi-family, and commercial generators. <br />Also, the City will need to amend the Franchise Agreement to comply with the final SB <br />1383 regulations. Specifically, the City will need to modify current Franchise <br />Agreement provisions, such as those related to collection services, record keeping, <br />reporting, and education and outreach obligations. <br />3. Collaborators <br />• City staff and consultants: Responsible for identifying necessary changes to the <br />Municipal Code and Franchise Agreement, drafting such changes, and, in the <br />case of the Franchise Agreement, negotiating changes with PGS. <br />Program and <br />Policy Changes <br /> <br />Detailed Program Action <br />Plans for each Program Area <br />are provided in Section 3: <br /> <br />□ Collection and Processing <br />□ Monitoring and <br />Enforcement <br />□ Product Procurement <br />□ Ordinances and Policies <br />□ Edible Food Recovery <br />□ Education and Outreach <br />□ Reporting and <br />Recordkeeping <br />
