Nowever, the City shall indemnify and hold Property Owner harmless for all <br />liability caused to third parties by City or its agent and contractors. <br /> <br /> 7. City's remedies. City may bring legal action to collect the sums <br />due as the result of expenses incurred by City, resulting from action under- <br />taken pursuant to Paragraph 6 or City may bring legal action for specific <br />performance. Property Owner agrees that if legal action by City is necessary, <br />Property Owner will pay City the reasonable sum as attorney's fees and court <br />costs. Property Owner shall pay within 30 days of its receipt of an invoice, <br />the cost incurred by City to maintain the landscaping, and in the event prompt <br />payment is not tendered, interest at a rate not to exceed 10% may be applied. <br /> <br /> 8. Notices. Any notice shall be given by either party to the other <br />party at the address shown below: <br /> <br /> Notices to City shall be addressed to the City of Pleasanton, 200 Bernal <br />Avenue, Pleasanton, California 94566. <br /> <br /> Notices to Property Owner shall be addressed to: <br /> P. O. Box 12916 <br /> <br /> Oakland, California 94604 <br /> <br /> Attention: Properties Department <br /> <br /> 9. Miscellaneous terms and provisions. <br /> <br /> (a) If any provision of this contract is adjudged invalid, <br /> <br /> the remaining provisions of it are not affected. <br /> <br /> (b) Notice to Property Owner shall be considered to have <br /> been given to owner when sent to owner's address <br /> stated above. <br /> <br /> (c) This writing contains a full, final and exclusive <br /> <br /> statement of the contract of the parties. <br /> <br /> (d) Property Owner appoints City its attorney-in-fact <br /> to do all acts and things which City considers <br /> necessary to restore or maintain the landscaping <br /> <br /> <br />
