3. Landscaping Plan. Reference is made to the Design Review Board <br />~roceedings of July 16, 1981 and the landscaping plan which, by condition 14 <br />of the Design Review Board's approval has been approved by the Planning <br />Department. Copies of said landscaping plan is kept on file with the City <br />in the Office of the Planning Director, Civic Center, 200 Bernal Avenue, <br />Pleasanton, California. <br /> <br /> 4. Landscaping as a benefit. The landscaping which Property Owner <br /> <br />is obligated to provide will materially benefit its property and it is <br />necessary to comply with the Design Review Board's approval conditions imposed <br />by City as a requirement of the development of the property, as shown in <br />Resolution R-81-25 incorporated by reference herein and attached hereto as <br />Exhibit "B". <br /> <br /> 5. Duty to maintain landscaping. Property Owner shall diligently <br />maintain and care for the landscaping which it installs, using generally <br />accepted methods for cultivation and watering. Property Owner shall maintain <br />that standard of care necessary to prevent the landscaping from deteriorating <br />to the extent that its value as landscaping is destroyed. <br /> <br /> 6. City may maintain landscapin9. If Property Owner fails to meet the <br />standard of maintenance necessary to keep the landscaping in a healthy condition, <br />City may take the steps necessary to assure that the landscaping is maintained <br />in a condition required by this Agreement. City shall serve a notice of its <br />intent to enter upon'the premises for this purpose. City shall mail the <br />notice to Property Owner's address as indicated in Paragraph 8 or to the <br />address shown on the tax rolls, at least 30 days in advance of the date on <br />which it intends to enter the premises. <br /> <br /> City may enter upon the property and perform such work as it considers <br /> reasonably necessary and proper to restore and maintain the landscaping. City <br /> may act either through its own employees or through an independent contractor. <br /> <br />-2- <br /> <br /> <br />
