by the Association to perform any maintenance required under <br />Sections 1.2, 2.2, and Article 3 must obtain an encroachment <br />permit from the City, which the City shall issue without <br />charge to such contractor or to the Association. <br /> <br /> ARTICLE 6 <br /> <br /> ASSESSMENT DISTRICT <br /> <br /> 6.1 Maintenance District Comtemplated. The City, <br />Prudential, CPP and the Association contemplate the possible <br />establishment of a landscaping and street lighting main- <br />tenance district (the "District") pursuant to California law <br /> <br />for the purposes of maintaining the landscaping, street <br />lighting, and other public improvements covered by this <br />agreement. <br /> <br /> 6.2 Cooperation. The City agrees that, upon <br />receipt of an appropriate petition, it shall cooperate with <br />Prudential, CPP, the Association, and other land owners <br />within Hacienda Business Park to undertake and complete any <br />proceedings required under California law for the establish- <br />ment of the District. <br /> <br /> 6.3 Termination of Association's Obligations. If <br />the District is established as provided in this article, the <br />Association's obligations under this agreement with respect <br /> <br />to any maintenance obligations to be undertaken by the <br />District shall terminate as of the first day of the first <br />fiscal year for which assessments are first levied by the <br />District. <br /> <br />-13- <br /> <br /> <br />
