Furthermore, implementation of MM CUL-1 <br />and MM CUL-2 would ensure any impacts to undiscovered TCRs encountered during project <br />construction would be reduced to a less that significant level. <br />e) A resource determined by the lead agency, in its discretion and supported by substantial <br />evidence, to be significant pursuant to criteria set forth in subdivision (c) of Public Resources <br />Code Section 5024.1. In applying the criteria set forth in subdivision (c) of Public Resources Code <br />Section 5024.1, the lead agency shall consider the significance of the resource to a California <br />Native American tribe. <br />Less than significant impact with mitigation incorporated. On March 16, 2021, the City of <br />Pleasanton sent letters containing project information and an invitation to consult on the project to <br />Tribal representatives pursuant to AB-52. The same day, the City received a response from the Indian <br />Canyon Band of Costanoan Ohlone People, expressing concern that the project’s APE may be in close <br />proximity to a potentially eligible cultural site. The tribe recommended that a Native American <br />Monitor and an Archaeologist be present on-site at all times in order to minimize potential effects on <br />the cultural site and mitigate inadvertent issues. The lead agency has not identified any additional <br />significant TCRs meeting the criteria set forth in subdivision (c) of Public Resources Code Section <br />5024.1, that may be adversely affected by the proposed project. However, the City concurred with <br />the Tribe’s recommendation, which has been included in MM CUL-1 and MM CUL-2, which would <br />ensure any impacts to undiscovered TCRs encountered during project construction would be <br />reduced to a less that significant level. <br />Mitigation Measures <br />MM CUL-1 All project related ground disturbance shall be monitored by an archaeologist who <br />meets the Secretary of the Interior’s Professional Qualification Standards for <br />archaeology and a Native American monitor from a culturally affiliated tribe <br />identified by the Native American Heritage Commission (NAHC). If any prehistoric or <br />historic artifacts, or other indication of cultural resources are found once the project <br />construction is underway, all work shall stop within 20-meters (66 feet) of the find. <br />The Archaeologist and Tribal Monitor shall be consulted for an immediate evaluation <br />of the find prior to resuming groundbreaking construction activities within 20- <br />meters of the find. The Applicant shall include a standard inadvertent discovery <br />clause in every construction contract to inform contractors of this requirement. If <br />the find is determined to be an important archaeological resource, the resource <br />shall be either avoided, if feasible, or recovered consistent with the requirements of <br />the State California Environmental Quality Act (CEQA) Guidelines. Potentially <br />significant cultural resources include, but are not limited to, stone, bone, glass, <br />wood, or shell artifacts or features, including hearths, structural remains, or historic <br />waste disposal sites. Any previously undiscovered resources found during <br />construction within the project site shall be recorded on appropriate Department of <br />Parks and Recreation (DPR) 523 forms and will be submitted to the City of <br />Pleasanton, the Northwest Information Center, and the California Office of Historic <br />Preservation (OHP), as required.
