Records search results from the NWIC <br />indicate that no archaeological resources have been recorded within a 0.5-mile radius of the project <br />site. Furthermore, the project site is entirely hardscaped indicating that subsurface soils are likely <br />highly disturbed, and an intensive pedestrian survey of the project site conducted by FCS on <br />February 5, 2021, failed to identify any indications of archaeological resources within the project <br />site. The project site is therefore considered to have low sensitivity for undiscovered archaeological <br />resources. <br />While the records search and survey data indicate the likelihood of encountering archaeological <br />resources during project construction is low, there is always a possibility that subsurface excavation <br />may encounter previously undiscovered prehistoric archaeological resources. Such resources could <br />consist of but are not limited to stone, bone, wood, or shell artifacts or features, including hearths <br />and structural elements. Accordingly, this is a potentially significant impact. Implementation of MM <br />CUL-1 would ensure that this potential impact is reduced to a less-than-significant level. <br />c) Disturb any human remains, including those interred outside of formal cemeteries? <br />Less than significant impact with mitigation incorporated. There are no records of historic <br />cemeteries, Native American burial sites, or other evidence that human remains may exist within the <br />project area. However, there is always the possibility that subsurface construction activities <br />associated with the proposed project, such as trenching and grading, could potentially damage or <br />destroy previously undiscovered human remains. Accordingly, this is a potentially significant impact. <br />In the event of the accidental discovery or recognition of any human remains, CEQA Guidelines <br />Section 15064.5, Health and Safety Code Section 7050.5, and Public Resources Code Sections <br />5097.94 and 5097.98 must be followed. In the unlikely event human remains are discovered, <br />implementation of MM CUL-2 would reduce this potential impact to a less than significant level. <br />Tribal Cultural Resources <br />Would the project cause a substantial adverse change in the significance of a tribal cultural resource, <br />defined in Public Resources Code Section 21074 as either a site, feature, place, cultural landscape <br />that is geographically defined in terms of the size and scope of the landscape, sacred place, or object <br />with cultural value to a California Native American tribe, and that is: <br />d) Listed or eligible for listing in the California Register of Historical Resources, or in a local register <br />of historical resources as defined in Public Resources Code Section 5020.1(k), or <br />Less than significant impact with mitigation incorporated. A review of the CRHR, local registers of <br />historic resources, a records search conducted at the NWIC, failed to identify any listed or eligible <br />TCRs that may be adversely affected by the proposed project. An NAHC sacred lands file search, <br />however, indicated that the project was positive for TCRs within the area, and recommended the <br />Muwekma Ohlone Indian Tribe be contacted for additional information. FCS contacted all 10 tribal <br />representatives and received two requests for additional information, which were provided. No
