It is noted in its discussion, one Planning Commissioner suggested the DA should <br /> include an "inflation" or "escalation" factor for the $1 Million contribution, given the <br /> payment would not be made immediately. Staff recommends the term be retained "as <br /> is," noting the City has not imposed similar requirements in other DAs, and doing so <br /> may require re-negotiation of other terms, which have been developed in the spirit of <br /> providing a fair and appropriate balance of benefits to the developer and to the City. <br /> Staff finds the $1 million payment reflects a fair request of the applicant, scaled <br /> appropriately to the additional FAR that is being required. It is also noted, in addition to <br /> this one specific benefit, the 10x Genomics development will contribute to City revenues <br /> in other ways (also potentially supportive of Fire Station No. 2 improvements), through <br /> the payment of development impact fees (which will escalate over time); and in return of <br /> a significant increase in sales tax, year-upon-year, over time. <br /> PLANNING COMMISSION ACTION <br /> The Planning Commission held a public hearing on May 26, 2021 , to review and provide <br /> a recommendation to the Council on the proposed project. The Executive Director of the <br /> Chamber of Commerce spoke in support of the proposed project. In addition, staff <br /> received six emails in support of the proposed project after publishing of the Planning <br /> Commission agenda report for the hearing (Attachment 8). <br /> As described in the "Discussion" section above, the majority of the Commission's <br /> comments were focused on the discussion on architectural design for Building 1; the <br /> Commission recommended, alongside approval of the various applications and the DA, <br /> the applicant provide an alternative color scheme for Building 1, for the City Council's <br /> consideration. As noted, staff believes the alternative scheme is a positive change to <br /> the project, and recommends it be incorporated into the project design. <br /> For staff's responses to and the Commission's discussion on these topics, please see <br /> the Planning Commission meeting minutes (Attachment 7). After listening to public <br /> testimony and discussing the project, the Commission, on a 5-0 vote, voted to <br /> recommend adoption of the MND, approval of the PUD Rezoning and Development <br /> Plan, and to make a finding the Development Agreement is in conformance with the <br /> General Plan, subject to the recommended conditions of approval. <br /> PUBLIC NOTICE <br /> Notice of this meeting was sent to property owners and tenants/occupants within <br /> 1,000-feet of the site as shown in Attachment 9. At the time of report publication, staff <br /> has not received any public comments beyond those responded to in the Final IS/MND <br /> in Attachment 1A and those addressed to the Planning Commission in Attachment 8. <br /> Public comments received after publication of this report will be forwarded to the City <br /> Council. <br /> 28 <br />
