ATTACHMENT #1 Contract#2019246 FIRST AMENDMENT TO AGREEMENT This First Amendment to Agreement("First Amendment") is entered into this day of June 2021, by the City of Pleasanton("City")and New Image Landscape Company ("Contractor"). Whereas, on October 17, 2018,the City and Contractor entered into an Agreement for three years to be completed on March 1, 2021 for Street Median Mulching Replenishment for identified City locations("Agreement"); and Whereas,the parties desire to amend the Agreement to continue the Street Median Replenishment as identified in as Routel Map in the Agreement by extending the term through March 1, 2022 and Route 2 Map to be extended through June 30, 2023. Now, therefore, in exchange for valuable consideration, the receipt of which is hereby acknowledged, the parties agree as follows: 1. The first paragraph of Section 1 of the Agreement(Work to be Performed) is amended to read as follows: Street median mulching replenishment in various landscape median planters throughout the City with the recycled wood chip mulch to be used available at no cost for Contractor to pick-up from the City's Operation Services Department at 3333 Busch Road, Pleasanton;the medians in Route 1 to have mulching replenishment occur from Notice to Proceed to be completed by March 1,2019;the medians in Route 2 to have mulching replenishment occur from September 1, 2019 to be completed by March 1, 2020; and the medians in Route 3 to have mulching replenishment occur from September 1, 2020 to be completed by March 1,2021; and the medians in Route 1 to have mulching replenishment occur from Notice to Proceed to be completed by March 1, 2022; and the medians in Route 2 to have mulching replenishment occur from Notice to Proceed to be completed by June 30, 2023 as more particularly described in the Specifications. 2. The following is added to Section 2 of the Agreement(Compensation): The total compensation for the work to be performed in Route 1 to be completed by March 1,2022 shall not exceed$60,000 and in Route 2 to be completed by June 30, 2023 shall not exceed $157,800. The total compensation for this Agreement shall not exceed $542,208. 3. This First Amendment may be executed in multiple counterparts, each of which shall be an original and all of which together shall constitute one agreement. Counterparts may be delivered via facsimile, electronic mail (including pdf or any electronic signature complying with U.S. federal E-Sign Act of 2000 (15 U.S. Code §7001 et seq.), California Uniform Electronic Transactions Act(Cal. Civil Code §1633.1 et seq.), or other applicable law)or other transmission method, and any counterpart so delivered shall be deemed to have been duly and validly delivered and be valid and effective for all purposes. 4.
