Proposition 218 Compliance
As noted above, the proposed assessments fund geologic monitoring and related
maintenance services, which provide: (1) all lands included within a district shall be
specially benefitted by construction proposed in a plan of control approved by the
legislative body and (2) the assessments were previously approved by all property
owners at the time the assessment was created. Since these criteria have been
satisfied, the GHAD assessments can be increased by an amount not exceeding the
ENR index without being subject to a Proposition 218 vote of current property owners.
DISCUSSION
At the May 18, 2021, Board of Directors meeting, the Board adopted a resolution
declaring an intention to order the cost of maintenance be assessed against the
property owners within each of the GHADs for FY 2021/22. As required by each GHAD,
the Board of Directors must levy an annual assessment on all parcels (including any
City's parcels) benefited by the GHAD.
At the assessment hearing, the Board shall hear and consider all protests and make
modifications, if determined necessary, to the proposed assessments. After the close of
the public hearing, the Board shall confirm the assessments as submitted by the
General Manager or otherwise determined, and order that the amount of each
assessment be levied against all parcels within each GHAD.
If the assessments are ordered, the City Clerk will record the Notice of Assessments
with the Alameda County Tax Collector as provided in California Streets and Highways
Code §3114.
Submitted by: Fiscal Review: Approved y:
/./K/
Stephen Kirkpatrick Tina Olson Nelson Fialho
Director of Engineering Director of Finance City Manager
Attachments:
1.
