ATTACHMENT #1 <br /> Contract# 2020123 <br /> SECOND AMENDMENT TO AGREEMENT <br /> This Second Amendment to Agreement("Second Amendment") is entered into this day of June <br /> 2021 by the City of Pleasanton ("City")and CD& Power("Contractor"). <br /> Whereas, on July 1, 2019 the City and Contractor entered into As Needed Maintenance and <br /> Trade Services Agreement("Agreement") for Contractor to provide services for the maintenance, <br /> replacement and repairs of generators of City's pump stations; and <br /> Whereas,on February 18, 2020 the parties entered into a First Amendment to increase the <br /> compensation in order to allow the Contractor to provide work on additional projects and rentals; and <br /> Whereas,the parties desire to amend the Agreement to increase the compensation for Fiscal <br /> Year 2020/21 and Fiscal Year 2021/2 to a total amount not to exceed $350,000; <br /> Now, therefore, in exchange for valuable consideration,the receipt of which is hereby acknowledged, <br /> the parties agree as follows: <br /> 1. Section 3 of the Agreement, "Compensation"is amended to read: <br /> "For Fiscal Year 2020/21 and Fiscal Year 2021/22, total compensation shall not exceed <br /> $350,000." <br /> 2.
