<br /> <br />building permits within the meaning of Paragraph 8 of <br />Court Order Exhibit B. <br />(6) That after adjusting for the effect <br />of the tolling described in subparagraph 5 above, ae of <br />October 11, 1983, the amount of the three year period <br />remaining to obtain building permits with respect to <br />the Property Sewer Permits is Four Hundred Eighty-Nine <br />(489) days. <br />(7) That the Owner may allocate the <br />Property Sewer Permits to improvements or subdivided <br />portions of the Property without the approval of City, <br />by Grant Deed or other instruments acceptable to Owner, <br />provided, however that Owner shall provide City with a <br />notice of assignment in each case upon such allocation. <br />4. Building Permit Limitation. The Court Orders <br />provide that the Sewer Permits are subject to the exclusive <br />control of the City. The Court Orders further provide that <br />a written agreement between a property owner and the City, <br />precluding the owner or its successor or assigns from <br />obtaining the necessary building permits for a specified <br />period of time tolls for that period of time, the three year <br />period for obtaining building permits. <br />A. The Owner of the Property shall not be <br />entitled to obtain building permits during the term of this <br />Amended Agreement except during the periods and subject to <br />9 <br />
