between a property owner and the City, precluding the owner or <br />its successors or assigns from obtaining the necessary building <br />permits for a specified period of time tolls for that period of <br />time, the three year period £or obtaining building permits. <br /> <br /> A. The O~n~er of the Property shall not be entitled to <br />obtain building permits during the term of t~is Agreement except <br />during the periods and subject to the limitations described below <br />or upon the use or expiration of all Property Sewer Permits in <br />accordance with Paragraph 5. In each case, the reference to the <br />number of Property Sewer Permits which may be used shall mean <br />that ~,mer shall not be entitled to obtain building permits <br />which, based on the sewer demand formula being generally aDmlied <br />by the City at the time, shall require Sewer ~ermits in excess of <br />the number which may be used pursuant to this Paragraph. <br /> <br /> (1) General Buildings. Owner may use the number <br />of Property Sewer Permits during the periods described below in <br />connection with construction df any buildings: <br /> <br /> (a) Phase One. Commencing May 1, 1984, <br /> O,~mer may use one hundred eleven (111) Property Sewer Permits <br /> ("Phase One Permits"). All Phase One Permits shall expire <br /> and the sewer capacity represented thereby shall revert to <br /> the sole control of the City as of September 2, 1985, <br /> except as provided below: <br /> <br /> (i) In the case of Phase One Permits <br /> which have been used to obtn~n building oerm~t~, that <br /> sewer capac:ity shall n~t t'~vc~:~ Io thc Ci[v u~lcs~ the <br /> building permit expires pursuant to Uniform Building <br /> <br /> <br />
