final thirty (30) days shall commence to run as to the <br /> Phase Three Restricted Permits one hundred and eighty <br /> (180) days after this restriction is imposed. (i.e. <br /> six hundred and fifty-three days after the commencement <br /> of Phase Three.) Thus, if Phase Three does commence on <br /> May 1, 1986, then the Phase Three Restricted Permits <br /> shall expire on March 1, 1988. <br /> <br /> (2) Hotel. The approved PUD provides for construction <br />of a hotel on the Property. Because of the size and sewer usage <br />characteristics of a hotel, special treatment is aDoropriate to <br />this possible use. Owner may use one hundred and thirty-one <br />(131) Property Sewer Permits for construction of a hotel during <br />the following periods: (i) from May 1, 1984 fhrough November 1, <br />1984; (ii) for the first one hundred and eighty (180) days of <br />Phase Two above. If those Property Sewer Permits are not used <br />for construction of a hotel during Phase One or Phase Two, then <br />those Permits may be used for any purpose consistent with the PUD <br />from the commencement of Phase Three until their expiration one <br />hundred and twenty-nine (129~ days after the commencement of <br />Phase Three. If Phase Three commences on May 1, 1986, then these <br />permits shall expire on September 7, 1986. <br /> <br /> (3) Governme~t Action or Litigation. In the <br /> <br />event of any governmental a~on or litigation that prevents <br />Owner from obtaining a builJ~ng permit (where Owner is <br />otherwise prepared to submi~ ~he necessary information and <br />pay th~ fees required in order to obtain a building permit) the <br />dates provided in subparagraphs (!) and (2) of this Paragraph 4 A <br /> <br /> <br />
