17 <br /> THE CITY OF <br /> f1. <br /> CITY COUNCIL AGENDA REPORT <br /> PLEASANTONC <br /> February 16, 2021 <br /> Community Development <br /> TITLE: P20-0412, CITY OF PLEASANTON - CONSIDER SECOND READING AND <br /> ADOPTION OF AN ORDINANCE APPROVING AMENDMENTS TO <br /> CHAPTERS 18.08, 18.28, 18.32, 18.36, 18.44, 18.46, 18.84, 18.88 AND <br /> 18.106 OF THE PLEASANTON MUNICIPAL CODE TO COMPLY WITH <br /> STATE LEGISLATION FOR ACCESSORY DWELLING UNITS <br /> SUMMARY <br /> At its January 19, 2021, meeting, the City Council voted to adopt an ordinance <br /> amending the Pleasanton Municipal Code (PMC) to align the code with recently <br /> adopted State law regarding accessory dwelling units (ADUs) with the direction that <br /> second-story ADUs, attached or detached, be prohibited citywide. The City Council <br /> also approved amendments to the Master Fee Schedule with respect to fees for ADUs. <br /> At this meeting, staff requests that the City Council consider waiving the second reading <br /> and adopting the ordinance as amended to reflect the City Council's direction on <br /> January 19. <br /> Although City Council directed that second story ADUs generally should not be <br /> permitted, this agenda report clarifies circumstances under which an ADU must be <br /> permitted on the second floor, as required by State law and guidance established by the <br /> Housing and Community Development (HCD). It also presents a staff recommendation <br /> regarding two-story ADUs in future Planned Unit Developments, as well as several <br /> clarifying revisions to the Ordinance that the City Council may wish to consider adding <br /> to the draft Ordinance. Finally, this report discusses the concept of and seeks direction <br /> on a future staff effort to develop preapproved, prototypical plans for detached ADUs <br /> that could be used to streamline review for the property owner and also provide <br /> exemplary and desirable architectural designs. <br /> PLANNING COMMISSION RECOMMENDATION <br /> The Planning Commission recommended the City Council approve the proposed draft <br /> amendments to the ADU ordinance at its October 28, 2020, meeting. <br /> RECOMMENDATION <br /> 1. Find that the proposed amendment to the Municipal Code is statutorily exempt from <br /> the provisions of the California Environmental Quality Act (CEQA) pursuant Public <br /> Resources Code Section 21080.17 and categorically exempt per CEQA Guidelines <br /> Section 15303; and <br />
