Waive second reading and adopt the draft ordinance, find the subject code <br /> amendment consistent with the General Plan, and approve Case P20-0412, <br /> amendment to the Pleasanton Municipal Code as shown in Attachment 1; <br /> 3. Direct staff to further research a program to develop preapproved prototypical ADU <br /> designs, and, with City Manager's authorization, move forward with a program if <br /> determined appropriate and as resources allow. <br /> Alternatively, the City Council could make further clarifying revisions to the Draft <br /> Ordinance, as outlined in the "Discussion" section, and recommend the Ordinance be <br /> revised accordingly and brought back for a final second reading. <br /> FINANCIAL STATEMENT <br /> No fiscal impact to the City or public service is anticipated with this amendment to the <br /> municipal code. <br /> BACKGROUND <br /> As noted, on January 19, 2021 the City Council voted, 4-1, to adopt the ordinance, with <br /> the clarification that no second story ADUs, attached or detached, be allowed. Staff has <br /> incorporated changes to the ordinance to reflect this direction, included as Attachment <br /> 1, for adoption by the Council at this meeting. In conjunction with these revisions, staff <br /> notes some points that are worthy of clarification with respect to second story ADUs and <br /> the changes reflected in Attachment 1; these are addressed in Part A of the <br /> "Discussion" section below. <br /> In addition, since the January 19 meeting, questions and comments staff received <br /> suggest it may be beneficial to make some additional clarifying revisions to the draft <br /> ordinance. At the City Council's direction, such revisions could be incorporated into the <br /> ordinance, in which case it would be returned to the City Council for a final second <br /> reading and adoption. The specific revisions are outlined further in Part B of the <br /> "Discussion" section. The last section of the "Discussion" section is about the City <br /> potentially providing prototypical designs for ADUs that meet State law with the <br /> objective of streamlining the City's review and providing a benchmark of preferred <br /> architectural styles and detailing. <br /> DISCUSSION <br /> A. Two-Story ADUs: Clarification of Revisions to Ordinance <br /> On January 19, the City Council discussed provisions of the Ordinance regarding two- <br /> story ADUs at some length. Absent the ability to conduct discretionary review on ADUs, <br /> City Council directed that two-story ADUs (both as two-story additions to the primary <br /> structure and two-story detached ADUs) be prohibited citywide. <br /> Notwithstanding this direction, pursuant to State law, the City must allow both of the <br /> following: <br /> 1. An ADU up to 16 feet in height, which could potentially accommodate two stories. <br /> Although these instances are likely to be limited due to minimum floor-to-ceiling <br /> Page 2 of 6 <br />
