<br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON
<br /> AUTHORIZING THE CITY MANAGER TO PURCHASE RENEWABLE 100
<br /> ELECTRICITY FROM EAST BAY COMMUNITY ENERGY (EBCE) FOR CITY
<br /> FACILITIES, TO DESIGNATE BRIGHT CHOICE AS THE DEFAULT PRODUCT FOR
<br /> RESIDENTIAL CUSTOMERS WHO ARE ENROLLED IN CALIFORNIA ALTERNATE
<br /> RATES FOR ENERGY(CARE), FAMILY ELECTRIC RATE ASSISTANCE (FERA), AND
<br /> MEDICAL BASELINE ACCOUNTS, AND TO DESIGNATE BRILLIANT 100 AS THE
<br /> DEFAULT PRODUCT FOR ALL OTHER RESIDENTIAL, COMMERCIAL AND
<br /> INDUSTRIAL ACCOUNTS
<br /> WHEREAS, on September 24, 2002, the Governor of California signed into law Assembly
<br /> Bill 117 (Stat. 2002, Ch. 838; see California Public Utilities Code section 366.2), which authorizes
<br /> any California city or county. whose governing body so elects, to combine the electricity load of
<br /> its residents and businesses in a community-wide electricity aggregation program known as
<br /> Community Choice Aggregation ("CCA"); and,
<br /> WHEREAS, the Act expressly authorizes participation in a CCA program through a joint
<br /> powers agency; and on December 1, 2016, the East Bay Community Energy Authority ("EBCE")
<br /> was formed under the Joint Exercise of Power Act, California Government Code sections 6500 et
<br /> seq., among the County of Alameda, and the Cities of Albany, Berkeley, Dublin, Emeryville,
<br /> Fremont, Hayward, Livermore, Piedmont, Oakland, San Leandro, and Union City to study.
<br /> promote. develop, conduct, operate, and manage energy and energy-related climate change
<br /> programs in all of the member jurisdictions; and the cities of Newark and Pleasanton, located in
<br /> Alameda County, along with the City of Tracy, located in San Joaquin County, were included as
<br /> members of EBCE and parties to the joint powers agreement in March of 2020; and,
<br /> WHEREAS, EBCE offers electricity customers within its member-jurisdictions multiple
<br /> energy service options at various rates, including those that are 100% renewable, and/or 100%
<br /> carbon-free, and/or a mixture of renewable and conventional energy resources; and,
<br /> WHEREAS, all of EBCE's service options meet or exceed the State of California's
<br /> Renewable Portfolio Standards ("RPS"), which can help member-jurisdictions meet their Climate
<br /> Action Planning goals; and,
<br /> WHEREAS, EBCE endeavors to provide competitively priced energy options to all eligible
<br /> residential, commercial, municipal and low-income customers throughout its service area, while
<br /> expanding access to renewable and carbon-free resources, and administering innovative energy-
<br /> related programs; and,
<br /> WHEREAS. due to EBCE's competitive rates, EBCE customers have collectively saved
<br /> approximately $10 million since 2018 compared to what they would have paid for Pacific Gas &
<br /> Electric's ("PG&E") standard service; and,
<br /> WHEREAS, EBCE customers in the City of Pleasanton may request to change their EBCE
<br /> service option and/or may opt out of EBCE service and return to PG&E service at any time.
