At the October 28 meeting, the Planning Commission by 5-0 vote <br /> recommended that the amendments proceed to the City Council for final review. <br /> Since the October 28 Planning Commission meeting, staff made a number of changes <br /> to the draft amendments to the PMC, highlighted as follows: <br /> • Clarified that if the ADU is for a multifamily development, the project plans must <br /> itemize the square footages of all multifamily units within the multifamily <br /> structure. This was added to facilitate accurate calculation of fees as required by <br /> statute. <br /> • Added language to reflect state law in that detached ADUs that are a result of the <br /> conversion of existing accessory structure may retain the height of the accessory <br /> structure even if the structure is greater than 16 feet in height and may maintain <br /> the same setbacks as the existing structure. <br /> • Clarified that an ADU proposed above a detached garage on a corner lot must be <br /> at least 10 feet from the street side property line. <br /> • Added clarifying language regarding method of measuring height for all detached <br /> accessory structures. <br /> • Clarified language regarding design, materials, and overall appearance of ADUs <br /> as it relates to the primary structure (as discussed in detail above). <br /> GENERAL PLAN CONFORMITY <br /> The City's General Plan includes the following policies to encourage ADUs: <br /> Housing Element Actively promote the creation of second units on single-family <br /> Policy 6 residential lots and their maintenance as sources of housing <br /> affordable to moderate-, low-, and very low-income households. <br /> Housing Element Conduct a review of the Second Unit Ordinance, including a survey <br /> Program 6.3 of similar requirements in other Bay Area cities. Using this review, <br /> consider allowing second units without an Administrative Design <br /> Review process in new single-family developments, subject to <br /> performance standards, consider reducing the existing Second Unit <br /> Ordinance requirements, such as the parking and height limit <br /> requirements, to encourage the development of second units, <br /> consider other measures to promote the creation of second units, <br /> and adopt necessary changes as appropriate. <br /> The amendments to the PMC would support and further these General Plan policies. <br /> Page 8 of 10 <br />
