<br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON AUTHORIZING
<br /> THE CITY MANAGER TO PURCHASE RENEWABLE 100 ELECTRICITY FROM EAST BAY
<br /> COMMUNITY ENERGY(EBCE)FOR CITY FACILITIES,AND TO DESIGNATE BRILLIANT 100
<br /> AS THE DEFAULT PRODUCT FOR RESIDENTIAL, COMMERCIAL AND INDUSTRIAL
<br /> ACCOUNTS
<br /> WHEREAS, on September 24, 2002, the Governor of California signed into law
<br /> Assembly Bill 117 (Stat. 2002, Ch. 838; see California Public Utilities Code section 366.2),
<br /> which authorizes any California city or county, whose governing body so elects, to combine the
<br /> electricity load of its residents and businesses in a community-wide electricity aggregation
<br /> program known as Community Choice Aggregation ("CCA"); and
<br /> WHEREAS, the Act expressly authorizes participation in a CCA program through a joint
<br /> powers agency; and on December 1, 2016, the East Bay Community Energy Authority ("EBCE")
<br /> was formed under the Joint Exercise of Power Act, California Government Code sections
<br /> 6500 et seq., among the County of Alameda, and the Cities of Albany, Berkeley, Dublin,
<br /> Emeryville, Fremont, Hayward, Livermore, Piedmont, Oakland, San Leandro, and Union City to
<br /> study, promote, develop, conduct, operate, and manage energy and energy-related climate
<br /> change programs in all of the member jurisdictions; and the cities of Newark and Pleasanton,
<br /> located in Alameda County, along with the City of Tracy, located in San Joaquin County, were
<br /> included as members of EBCE and parties to the joint powers agreement in March of 2020; and
<br /> WHEREAS, EBCE offers electricity customers within its member jurisdictions multiple
<br /> energy service options at various rates, including those that are 100% renewable, and/or 100%
<br /> carbon-free, and/or a mixture of renewable and conventional energy resources; and
<br /> WHEREAS, all of EBCE's service options meet or exceed the State of California's
<br /> Renewable Portfolio Standards ("RPS"), which can help member jurisdictions meet their Climate
<br /> Action Planning goals; and
<br /> WHEREAS, EBCE endeavors to provide competitively priced energy options to all
<br /> eligible residential, commercial, municipal and low-income customers throughout its service
<br /> area, while expanding access to renewable and carbon-free resources, and administering
<br /> innovative energy-related programs; and
<br /> WHEREAS, due to EBCE's competitive rates, EBCE customers have collectively saved
<br /> approximately $10 million since 2018 compared to what they would have paid for Pacific Gas &
<br /> Electric's ("PG&E") standard service; and
<br /> WHEREAS, EBCE customers in the City of Pleasanton may request to change their
<br /> EBCE service option and/or may opt out of EBCE service and return to PG&E service at any
<br /> time.
<br /> NOW, THEREFORE BE IT RESOLVED, THE CITY COUNCIL OF THE CITY OF
<br /> PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING:
