6. Approved and authorized City Manager to execute the first amendment to the Memorandum of <br /> Understanding (MOU) with the City of Dublin, the City of Livermore and Stanford Health Care — <br /> ValleyCare for the provision of COVID-19 testing services at the Alameda Fairgrounds for the <br /> period of April 28, 2020 to August 28, 2020 to include the terms of the City's MOU with Alameda <br /> County <br /> Operations Services <br /> 7. Approved and authorized City Manager to execute amendment to agreement with WRA, Inc. for <br /> stream and pond routine maintenance permitting support for an additional $45,600 which includes <br /> a 20 percent contingency of$7,600 for a total contractual amount not-to-exceed $256,904 <br /> MOTION: It was m/s by Pentin/Testa to approve the Consent Calendar as submitted and as <br /> noted. Motion passed by the following vote: <br /> Ayes: Councilmembers Brown, Pentin, Testa, Narum, Mayor Thorne <br /> Noes: None <br /> Absent: None <br /> MEETING OPEN TO THE PUBLIC <br /> 8. Public Comment <br /> Vittoria Tommasini encouraged City Council to implement enforcement of face masks through fines or <br /> citations. <br /> John Bauer commented it is only a matter of time before law enforcement cannot use the Graham v. <br /> Connor case as justification for unreasonable use of force. He noted the Darren Burley case makes it <br /> clear municipalities will bear the financial consequences of actions taken by their officers. He <br /> encouraged City Council to pause the community policing discussion until the new City Council has <br /> taken office. <br /> Isabella Mariano encouraged City Council to implement enforcement of mask wearing through fines or <br /> citations. Councilmember Testa clarified Ms. Mariano is inquiring on what could be done by City <br /> Council. City Manager Fialho clarified City Council could adopt an ordinance which would be brought <br /> forward by a 1st and 2nd reading followed by 30 days of implementation before it becomes enforceable. <br /> Additionally, he noted City Council could initiate administrative citations enforced by the Pleasanton <br /> Police Department. <br /> Gabriel Araiza requested an update of the Old Vineyard Avenue Trail Project, Phase 3. City Manager <br /> Fialho reported the project is not funded but staff recently revisited the location to reassess the <br /> situation. He hopes to bring a plan in 2021 to City Council and the Planning Commission with a <br /> recommendation on design and construction but does not see the project starting until after July 1, <br /> 2021. <br /> 9. Presentation of Proclamation of September 17-23, 2020 as Constitution Week <br /> Councilmember Testa presented the proclamation to Cindy Newbold and Debbie Janes of the José <br /> Maria Amador Chapter, National Society Daughters of the American Revolution who thanked City <br /> Council for their support. <br /> PUBLIC HEARINGS AND OTHER MATTERS <br /> City Council Minutes Page 2 of 8 September 1,2020 <br />
