CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 04-016 <br /> <br />RESOLUTION UPHOLDING THE APPEAL OF CASE PAP-57, THEREBY <br />APPROVING THE APPLICATION OF GLENN KIERSTEAD, CALIFORNIA <br />SPLASH, LLC, FOR CONDITIONAL USE PERMIT AND DESIGN REVIEW <br />APPROVALS, AS FILED UNDER CASE PCUP-63/PDR-243 <br /> <br />WHEREAS, <br /> <br />Glenn Kierstead, Califomia Splash, LLC, has applied for conditional use permit <br />and design review approvals to expand the existing water park facilities and <br />related improvements at Shadow Cliffs Regional Recreation Area located at <br />2500 and 3320 Stanley Boulevard; and <br /> <br />WHEREAS, zoning for the property is Public and Institutional (P) District; and <br /> <br />WHEREAS, <br /> <br />at its meeting of December 10, 2003, the Planning Commission, after having <br />considered all public testimony, relevant exhibits, and recommendations of City <br />staff concerning this application, denied the application and recommended that the <br />City Council direct staff to initiate a PUD rezoning of the properties so that <br />projects on the properties in the future would be subject to a referendum by the <br />citizens of the community; and <br /> <br />WHEREAS, within the time specified by the Pleasanton Municipal Code, the applicant <br /> submitted an appeal to the decision of the Planning Commission; and <br /> <br />WHEREAS, <br /> <br />at its meeting of March 16, 2004, the City Council received a report from the <br />Director of Planning and Community Development, together with a copy of the <br />staff report to the Planning Commission, regarding this matter; and <br /> <br />WHEREAS, <br /> <br />the City Council held a public hearing on March 16 and March 23, 2004, at which <br />time the applicant and other members of the public were offered an opportunity to <br />present evidence regarding this appeal; and <br /> <br />WHEREAS, <br /> <br />after a review of the materials presented and a discussion to scale back the project, <br />the City Council made the conditional use findings for the project and determined <br />that the proposed conditional use permit and design review, as conditioned and <br />scaled back, are appropriate and are consistent with the zoning regulations for the <br />zoning district of the property. <br /> <br /> <br />
