Resolution No. 04-015 Page Two WHEREAS, the City Council has determined that no substantial changes have been proposed to the project due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; and WHEREAS, the City Council has likewise determined that no substantial changes have been proposed with respect to the cimnmstances under which the project is undertaken due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects; and WHEREAS, the City Council has further determined that no new information of substantial importance has occurred which was not known and could not have been known with the exercise of reasonable diligence at the time the previous negative declaration was adopted, which shows the project will have one or more significant effects not discussed in the negative declaration; and WHEREAS, the City Council has also determined to scale back the size of the project by allowing no more than four new water slides to be located on the existing water slide hill, which would reduce the number of patrons at the park and, consequently, further mitigate possible impacts associated with traffic, noise, water consumption, air quality, and aesthetics. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES AS FOLLOWS: Section 1. Section 2. Section 3. Section 4. Finds that the proposed project would not have any significant adverse effects on the environment. Finds that the proposed project will have no potential for adverse impacts on the site's wildlife. Finds that the Mitigated Negative Declaration is adequate for the proposed expansion of the existing water facility project. The City staff is directed to cause a Notice of Determination to be filed pursuant to Section 5.4(g) of Resolution No. 77-66.
