Resolution No. 04-015 <br />Page Two <br /> <br />WHEREAS, <br /> <br />the City Council has determined that no substantial changes have been <br />proposed to the project due to the involvement of new significant <br />environmental effects or a substantial increase in the severity of previously <br />identified significant effects; and <br /> <br />WHEREAS, <br /> <br />the City Council has likewise determined that no substantial changes have <br />been proposed with respect to the cimnmstances under which the project is <br />undertaken due to the involvement of new significant environmental effects <br />or a substantial increase in the severity of previously identified significant <br />effects; and <br /> <br />WHEREAS, <br /> <br />the City Council has further determined that no new information of <br />substantial importance has occurred which was not known and could not <br />have been known with the exercise of reasonable diligence at the time the <br />previous negative declaration was adopted, which shows the project will <br />have one or more significant effects not discussed in the negative <br />declaration; and <br /> <br />WHEREAS, <br /> <br />the City Council has also determined to scale back the size of the project by <br />allowing no more than four new water slides to be located on the existing <br />water slide hill, which would reduce the number of patrons at the park and, <br />consequently, further mitigate possible impacts associated with traffic, <br />noise, water consumption, air quality, and aesthetics. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br /> <br />Section 1. <br />Section 2. <br />Section 3. <br />Section 4. <br /> <br />Finds that the proposed project would not have any significant adverse <br />effects on the environment. <br /> <br />Finds that the proposed project will have no potential for adverse impacts <br />on the site's wildlife. <br /> <br />Finds that the Mitigated Negative Declaration is adequate for the proposed <br />expansion of the existing water facility project. <br /> <br />The City staff is directed to cause a Notice of Determination to be filed <br />pursuant to Section 5.4(g) of Resolution No. 77-66. <br /> <br /> <br />
