CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 04-015 <br /> <br />RESOLUTION APPROVING A NEGATIVE DECLARATION FOR THE <br />APPLICATION OF GLENN KIERSTEAD, CALIFORNIA SPLASH, LLC, <br />FOR CONDITIONAL USE PERMIT AND DESIGN REVIEW <br />APPROVALS, AS FILED UNDER CASE PCUP-63/PDR-243 <br /> <br />WHEREAS, <br /> <br />in December 2002, the East Bay Regional Park District, as lead agency for <br />the project, adopted a Mitigated Negative Declaration for its Land Use Plan <br />Amendment for Shadow Cliffs Regional Recreation Area to add the <br />approximately 11-acre De Silva parcel to the park, to allow an expansion to <br />the existing water facility, and to allow the City of Pleasanton to construct a <br />bicycle motor-cross (BMX) facility; and <br /> <br />WHEREAS, <br /> <br />On July l5, 2003, the City Council used the Mitigated Negative <br />Declaration in its review of the General Plan amendment and rezoning of <br />the 15.77-acre De Silva parcel (3320 Stanley Boulevard), a portion of <br />which forms part of the site designated for the expansion of the existing <br />water facility project under consideration; and <br /> <br />WHEREAS, <br /> <br />on March 16, 2004, the City Council received and reviewed the same <br />Mitigated Negative Declaration and received the recommendations of staff <br />and Planning Commission for the expansion of the existing water facility <br />project; and <br /> <br />WHEREAS, <br /> <br />a duly noticed public hearing was held on March 16, 2004, at which time <br />the public was given the oppommity to comment on the environmental <br />impacts of the proposed project; and <br /> <br />WHEREAS, <br /> <br />the City Council has considered the Mitigated Negative Declaration in <br />accordance with the applicable state and local guidelines goveming the <br />preparation of Negative Declarations and Environmental Impact Reports. <br /> <br /> <br />
