CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, ALAMEDA RESOLUTION NO. 04-015 RESOLUTION APPROVING A NEGATIVE DECLARATION FOR THE APPLICATION OF GLENN KIERSTEAD, CALIFORNIA SPLASH, LLC, FOR CONDITIONAL USE PERMIT AND DESIGN REVIEW APPROVALS, AS FILED UNDER CASE PCUP-63/PDR-243 WHEREAS, in December 2002, the East Bay Regional Park District, as lead agency for the project, adopted a Mitigated Negative Declaration for its Land Use Plan Amendment for Shadow Cliffs Regional Recreation Area to add the approximately 11-acre De Silva parcel to the park, to allow an expansion to the existing water facility, and to allow the City of Pleasanton to construct a bicycle motor-cross (BMX) facility; and WHEREAS, On July l5, 2003, the City Council used the Mitigated Negative Declaration in its review of the General Plan amendment and rezoning of the 15.77-acre De Silva parcel (3320 Stanley Boulevard), a portion of which forms part of the site designated for the expansion of the existing water facility project under consideration; and WHEREAS, on March 16, 2004, the City Council received and reviewed the same Mitigated Negative Declaration and received the recommendations of staff and Planning Commission for the expansion of the existing water facility project; and WHEREAS, a duly noticed public hearing was held on March 16, 2004, at which time the public was given the oppommity to comment on the environmental impacts of the proposed project; and WHEREAS, the City Council has considered the Mitigated Negative Declaration in accordance with the applicable state and local guidelines goveming the preparation of Negative Declarations and Environmental Impact Reports.
