Councilmember Testa commented it is the elimination of redevelopment and funding that has created the lack of affordable housing. She noted Pleasanton has a policy of 15% to 20% of inclusionary affordable housing in the most recent development projects. She advised Pleasanton has investigated where high-density housing would fit without harming neighborhoods. She does not oppose affordability but opposes mandates and commented SB 50 and SB 827 were real estate bills camouflaged as affordable housing bills. She encouraged the state to give zoning control to local municipalities. Councilmember Testa encouraged City Council to change staff's recommendation on AB 3040, SB 902, SB 905, and oppose the bills. She thanked the Tri-Valley Cities Housing and Policy Framework for their great job of being a voice in the legislation. Councilmember Pentin expressed support for the item and believes it is up to the City Council to make affordable housing in Pleasanton happen by being in front of legislation, working through the League of California Cities, working with Townsend Public Affairs, and working with the Tri-Valley Council. MOTION: It was m/s by Narum/Pentin to accept staff's recommendation to establish the City's legislative positions on selected bills and request City staff to monitor remaining legislation throughout the 2020 legislative cycle to determine whether the City Council should take a formal position. Motion passed by the following vote: Ayes: Councilmembers Brown, Narum, Pentin, Testa, Mayor Thorne Noes: None Absent: None Assistant to the City Manager Hopkins reported SB 1383 (Jackson) would amend the California Family Rights Act and would require any employer, public or private, with only five employees to provide 12 weeks of protected leave each year and threatens litigation for any unintentional mistake. She advised the bill is currently in the Suspense File and noted staff recommends opposition to the bill. Assistant to the City Manager Hopkins reported AB 2560 (Quirk), AB 2054 (Kamlager), and AB 2178 (Levine) all deal with Water and Emergency Preparedness. She reported AB 2650 would allow a public process around water quality notification levels and response levels, AB 2054 is a grant program in response to emergency preparedness and how to engage community organizations and nonprofits during emergencies, and AB 2178 would allow the City in the event of a power shutoff emergency to declare a local emergency. She noted staff recommends supporting the bills. Mr. Ramirez reported AB 2178 was stuck in the Senate Governmental Organization Committee and does not anticipate the bill moving this year. He noted they are waiting for the California Public Utilities Commission (CPUC) to develop a solution. Assistant to the City Manager Hopkins encouraged City Council to continue to support the item since staff has been engaging the CPUC and showing support for the bill. Assistant to the City Manager Hopkins reported the AB 3069 (Chiu) is in Senate Appropriation in the Suspense File. She reported Mayor Thorne sent a letter opposing the bill, but the bill has not changed enough for staff to change their position. She noted staff recommends opposing the item unless amended. Police Chief David Swing presented on Policing - Use of Force bills which include AB 1022 (Holden), AB 1196 (Gipson), AB 1506 (McCarty), and AB 1709 (Weber). He advised AB 1022 would require law enforcement agencies to adopt policies to require officers to immediately report potential excessive force and to intercede when observing excessive force. He reported staffs position is to oppose unless amended since the bill would require that an officer who fails to intercede be disciplined in the same manner as the officer who used excessive force. He advised the bill is in Senate Appropriations Suspense File. He reported on AB 1196 which would prohibit the use of crowd restraint in California City Council Minutes Page 10 of 14 August 18, 2020
