Ordinance 1903 <br />Page 3 <br /> <br />WHEREAS, <br /> <br />WI-IEREA§, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />WHEREAS, <br /> <br />the factual findings made on September 23, 2003 continue to be valid and relate to <br />the amendments made to the uniform code in this adoption; and <br /> <br />the City Council hereby determines that the proposed ordinance establishes <br />requirements greater than those set forth in the 2001 Edition of the California <br />Building Standards Code, Title 24 of the California Code of Regulations (24 <br />C.C.R.), as adopted by the City of Pleasanton and set forth in Sections 20.08.012, <br />20.08.120 and 20.08.121 of the Pleasanton Municipal Code; and <br /> <br />the City Council finds that the aforementioned change which is set forth in this <br />ordinance is reasonably necessary, and said Council further finds that the <br />following factors support the local necessity for the aforementioned proposed <br />change; <br /> <br />As to Sections 20.08.012 (Deletions), 20.08.120 (Division III of Chapter 34), <br />20.08.121 (Structural Repairs), the City of Pleasanton is located in a very active <br />seismic area (seismic zone 4) and is located roughly between the Calavaras and <br />Greenville faults. Since in all likelihood, the City of Pleasanton will be involved <br />in a natural disaster in the future, it is prudent for the City to comply with federal <br />rules for natural disaster reimbursement. A recent change in federal law, as <br />provided in FEMA Regulation 44 CFR Part 206, requires that post-disaster <br />funding from FEMA to repair buildings damaged during a declared natural <br />disaster be repaired in accordance with the uniform, national standards. Each local <br />jurisdiction, therefore, must have in place standards detailing damage levels and <br />the extent to which buildings are to be repaired. These new code sections shall <br />bring the City of Pleasanton into FEMA compliance. <br /> <br />In addition, Section 20.08.121 (Structural Repairs) was amended to clarify that the <br />reference to the Building Code in Appendix Chapter 34, Division III is the <br />Building Code of the Pleasanton Municipal Code. In addition, this section was <br />amended to clarify that the Building Official has authority to establish the damage <br />ratio of damaged buildings. <br /> <br />the City Council finds that because of the reasons stated, the State of California <br />adopted Building Standards Code, Specifications, and Standards in their entirety <br />do not adequately address the life safety requirements of the City of Pleasanton; <br />and <br /> <br />the City Council finds that because of the local topography and recent seismic <br />activity and pursuant to Health and Safety Code Section 18941.5, the requirements <br />of the Pleasanton Municipal Code Sections 20.08.120 and 20.08.121 and the codes <br />and standards of this ordinance are necessary for the health, safety and welfare of <br />the residents of the City of Pleasanton; <br /> <br /> <br />
