Open-Space Management and Wildland Fire Protection Plan by Olberding <br /> Environmental, Inc., dated July 2019 <br /> The project materials listed above are collectively the "Approved Plans." <br /> THIS APPROVAL IS GRANTED SUBJECT TO THE FOLLOWING CONDITIONS: <br /> 1. FUTURE SUBDIVISION: With the approvals of amendments to the NSSP under Case <br /> No. P19-0031 and PUD rezoning under Case No. P19-0030, the maximum number of <br /> residential units on the project site, identified as Parcel #24 by NSSP, is five: 3 new <br /> single-family residential lots located in the approximately 1.01-acre PUD-MDR portion of <br /> the site fronting Sycamore Creek Way, and two single-family residential lots located in <br /> the approximately 2.28-acre PUD-A portion of the site fronting Sycamore Road. No <br /> further subdivision of the project site shall be allowed. (Project Specific Condition) <br /> 2. PUBLIC AMENITY CONTRIBUTION: The monetary contribution in the amount of <br /> $100,000 to be used for public bicycle and pedestrian trail improvements in the City, with <br /> priority given to projects in the vicinity of the proposed subdivision shall be paid in full prior to <br /> recordation of Final Map. (Project Specific Condition) <br /> 3. APPROVAL AND REVISIONS: The proposed development shall be in substantial <br /> conformance with the "Approved Plans," except as modified by the following conditions. <br /> Minor changes to the plans may be allowed subject to the approval of the Director of <br /> Community Development if found to be in substantial conformance with the approved <br /> exhibits. Planning Division approval is required before any changes are implemented in <br /> site design, grading, architectural design, house colors or materials, green building <br /> measures, landscape material, etc. <br /> 4. EXPIRATION: The PUD development plan shall lapse two years from the effective date <br /> of this ordinance unless a final map, as applicable, is approved. If a final map is <br /> approved, the PUD development plan approval shall lapse when the final map approval <br /> expires. If the map is recorded before the final map expires, then the PUD development <br /> approval shall not lapse. <br /> 5. CONDITIONS OF APPROVAL CHECKLIST: The applicant shall submit a "Conditions of <br /> Approval Checklist" indicating all conditions in Exhibit A have been satisfied, <br /> incorporated into the building permit plans or improvements plans, and/or addressed. <br /> Said checklist shall be attached to all building permit and engineering permit submittals <br /> for review by the City prior to issuance of permits. <br /> 6. GROWTH MANAGEMENT PROGRAM: The project shall meet all requirements of the <br /> City's Growth Management Program, as determined by the Director of Community <br /> Development; or Growth Management Agreement, if applicable. <br /> 7. PUD PERIOD: The building permit submittal will only be accepted after the ordinance <br /> approving the Planned Unit Development (PUD) development plan becomes effective, <br /> unless the applicant submits a signed statement acknowledging the plan check fees may <br /> be forfeited in the event the ordinance is overturned. In no case will a building permit be <br /> issued prior to the PUD ordinance being in effect. <br /> PUD-135 City Council <br /> Page 2 of 23 <br />
