Jen Grand-Lejano spoke in support of the ordinance with a 3 -6 -month implementation period, removal of <br />any civil or criminal penalties for youth tobacco distribution, and the inclusion of minimum prices and pack <br />sizes and a tobacco retail license program. <br />Amaya Wooding expressed her support for the ordinance citing a survey done by the California <br />Department of Public Health disclosing tobacco sales to underage decoys. <br />John Heinz spoke in opposition to the ordinance, stating underage smokers will find a way to buy tobacco <br />despite the ordinance. <br />Kina Atkin -Yamaguchi expressed her support for the ordinance. <br />Kelly Mokashi spoke in support of the ordinance with the inclusion of minimum prices and pack sizes with <br />no exemptions. <br />Karen Halfon spoke in support of the ordinance with the inclusion of minimum prices and pack sizes with <br />no exemptions. <br />Joseph Haddad expressed his opposition to the ordinance stating that underage smokers will find a way <br />to buy tobacco despite the ordinance and requested a lengthy implementation period. <br />Nathan Subramanian spoke in support of the ordinance with the inclusion of a tobacco retailer license <br />program. <br />Liz Williams spoke in support of the ordinance with the inclusion of a tobacco retailer license program <br />and minimum prices and pack sizes with no exemptions. <br />Audrey Abadilla expressed her support of the ordinance with the inclusion of minimum prices and pack <br />sizes with no exemptions. <br />Mayor Thorne closed the public hearing. <br />Councilmember Brown motioned for passage of the first two recommendations prohibiting the sale of <br />flavored tobacco city-wide without exemptions and prohibiting the sale of electronic smoking devices and <br />related paraphernalia city-wide without exemptions. <br />Councilmember Narum seconded the motion but plans to ask that staff, in conjunction with the City of <br />Livermore, consider a carve out for premium and flavored pipe tobacco and flavored cigars. <br />Councilmember Testa expressed her support of the two recommendations but does not support a carve <br />out for premium and flavored pipe tobacco and flavored cigars. <br />MOTION: It was m/s by Brown/Narum to prohibit the sale of flavored tobacco citywide, no exceptions, <br />and prohibit the sale of electronic smoking devices and related paraphernalia citywide, no exceptions. <br />Motion passed unanimously. <br />City Council Minutes Page 6 of 8 May 5, 2020 <br />
