Urban Growth Boundary: The Pleasanton General Plan indicates the urban <br />growth boundary is a line distinguishing land generally suitable for urban <br />development from land generally suitable for long-term open -space protection. <br />The intent of the UGB is to permanently define the line beyond which urban <br />development may not occur. The 1996 General Plan established an UGB and <br />voters ratified the UGB with approval of Measure FF, also in 1996. Accordingly, <br />a vote is required to modify the UGB (unless determined by City Council to be a <br />minor adjustment).3 <br />All three parcels are outside Pleasanton's UGB and inside Livermore's UGB. If <br />Pleasanton were to contemplate annexing some or all three of the parcels, its <br />UGB would need to be modified.4 <br />Sphere of Influence: Government Code §56076 defines sphere of influence as a <br />plan for the probable physical boundaries and service area of a local agency, as <br />determined by LAFCo. LAFCo most recently adopted Pleasanton's SOI, and that <br />of all jurisdictions within Alameda County, in January 2018. Although inclusion <br />within a local agency's SOI signals the long-term intent to ultimately consider <br />incorporation or annexation of those lands, it does not reflect a requirement or <br />commitment to do so. <br />SMP -38 and SMP -39 are located inside Pleasanton's SOI and outside <br />Livermore's SOI. Currently, SMP -40 is within the SOI of both Pleasanton and <br />Livermore.5 <br />3 In November 2000, the voters of Alameda County approved an Urban Growth Boundary (Measure D) which <br />is coterminous with the city's Urban Growth Boundary in Pleasanton and also includes the Cities of Livermore <br />and Dublin. <br />4 Program 22.2 of the Pleasanton General Plan indicates that urban services should only be extend to areas <br />within the UGB but identified potential exceptions, one of which is to extend urban services to reclaimed land <br />which is currently designated as Sand and Gravel Harvesting in East Pleasanton when the potential future use <br />is non -urban. <br />Program 22.6 indicates that the UGB locations in East Pleasanton should be reevaluated at such time as <br />comprehensive land -use designation changes are considered for the reclaimed quarry lands. <br />SMP -38, SMP -39, and SMP -40 are currently not within the East Pleasanton Specific Plan areas defined by the <br />Pleasanton General Plan. <br />5 LAFCo staff has reported discussions between Pleasanton and Livermore regarding SMP -40 occurred <br />decades ago, and at the time both cities agreed that if the area remained in quarry use, it should be in <br />Pleasanton's SOI, but if it were to be developed, then it would likely be annexed to Livermore and would need <br />to be in Livermore's SOI. LAFCo staff determined that SMP -40 was moved from Pleasanton's SOI to <br />Livermore's SOI in 1988 but had since received a petition from the property owner to modify the property's <br />SOI such that it was in Pleasanton. <br />Subsequently, SMP -40 was the subject of the "shared SOI" concept proposed by LAFCo with the latest <br />Municipal Services Review, meaning that this parcel is within the SOI of both Pleasanton and Livermore. At <br />Pleasanton's request, LAFCo agreed to reconsider this "shared SOI" concept such that Pleasanton's SOI did <br />not include SMP -40. At this time, the adopted Municipal Services Review as of January 2018 indicates that <br />Page 4 of 10 <br />
