Pleasanton Police Department <br />Pleasanton PD Policy Manual <br />Body Worn Camera Systems <br />d. gang enforcement activities; <br />e. vehicle pursuits; <br />f. K9 deployments, (i.e., cover officers, perimeter officers, etc.); <br />g. prisoner transport until which time the prisoner has been secured in a holding cell or released <br />from the officer's custody; <br />h. maintaining the peace at a protest or rally; <br />responding Code 3; <br />j. any other situation where an officer or supervisor reasonably determines that its use would <br />be appropriate or valuable to document an incident or record contact between members of the <br />public and the department. <br />Members who do not record as required by this policy shall articulate their reason(s) for not utilizing <br />their BWCS in the appropriate CAD entry and/or report and in a memorandum to the Division <br />Commander immediately after the conclusion of the incident, or as soon thereafter as reasonably <br />possible. <br />It shall be a violation of this policy for a members to intentionally fail to activate the BWCS or <br />terminate the recording in order to commit a violation of the law or any Department Policy. <br />450.3.1 TERMINATION OF BWCS RECORDINGS <br />Once a BWCS recording has been activated as provided in this Policy, it shall not be terminated <br />until the incident has concluded and no further communication with the participants or witnesses <br />is reasonably anticipated. Recording may also be stopped when the member or Supervisor <br />reasonably determines that there would be no further evidentiary or documentary value in <br />continuing to record an incident. The reasons for termination of recording before the conclusion <br />of an incident shall be articulated in the appropriate CAD entry or report of the incident. <br />450.3.2 PROHIBITED USE OF THE BWCS <br />Members are prohibited from using BWCS to record personal interactions with or between other <br />department members or employees, or members of the public for any personal or non -law <br />enforcement -related purpose. <br />Members are prohibited from making copies, retaining a copy, or duplicating, or distributing <br />any recordings without the permission of the Division Commander for any purpose that is not <br />related to the member's official police duties or as required for any criminal, civil or administrative <br />hearing or proceeding (i.e. as requested by the District Attorney, or required for criminal or civil <br />discovery.) Members are prohibited from using personally owned audio or video recording devices <br />during the course and scope of their law enforcement duties, as described herein, exceptwhere <br />the member has received the express consent of the Division Commander to use a personally <br />owned device. Any member who is granted permission to use a personally owned audio or video <br />recorder or any other recording device shall comply with the provisions of this policy relating to <br />usage, retention, documentation, and all disclosure requirements. <br />Copyright Lexipol, LLC 2020/09/22, All Rights Reserved.
