b. License for Construction. Such City written approval includes a license to enter the <br /> City's open space where the Private Utility Easement is located and utilize five feet <br /> (5') of land on either side of the Private Utility Easement during construction and <br /> installation of the private utility lines. Such entry for initial construction and <br /> installation shall be coordinated in advance with the City's Engineering Division. <br /> c. Security. Prior to commencement of initial construction and installation, Grantees, or <br /> their contractor, shall post a bond or other security in an amount in the reasonable <br /> discretion of the City Engineer, or his or her designee, equal to the cost to restore the <br /> Private Utility Easement. <br /> 2. Grantees covenant that any booster pump, electrical service, back flow prevention device, <br /> water meter, utility vaults, or other structures to support the private utility lines shall not be <br /> installed within the Private Utility Easement. <br /> 3. Grantees shall pay all required City and regional water and sewer connection and meter <br /> fees prior to installation of the private water and sewer lines in the Private Utility Easement; <br /> unless Grantees provide proof to the City's Building and Safety Inspection Division that such <br /> fees have already been paid for 3466 Old Foothill Road. <br /> 4. Grantees acknowledge that any backflow prevention device serving the private water line <br /> shall be subject to annual inspection by the City's Water Division and payment of then current <br /> annual fees. <br /> 5. Grantees covenant that the private utilities within the Private Utility Easement shall only <br /> serve the existing single family residence at 3466 Old Foothill Road. If Grantees seek to extend <br /> the private utilities to serve other persons or property, including a subdivision of 3466 Old <br /> Foothill Road, Grantees acknowledge that such extension is subject to the prior written approval <br /> of the City in the City's absolute discretion. <br /> a. Grantees further acknowledge that if it is found that Grantees have impermissibly <br /> extended the private utilities to serve beyond the single family residence at 3466 Old <br /> Foothill Road,that is grounds for City disconnection of City water service to 3466 <br /> Old Foothill Road, and revocation of the Private Utility Easement. <br /> II. Maintenance Covenant. <br /> A. Grantees shall, at no expense to the City, install,maintain, repair and replace, where <br /> necessary,the private utility lines within the Private Utility Easement in compliance with the <br /> construction plans approved by the City as described in 1., above. <br /> a. Any required modifications to the private utility lines from the approved <br /> construction plans shall require advance written approval from the City's <br /> Engineering Division. <br /> Page 2 of 4 <br />
