PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2003-52 <br />RESOLUTION APPROVING THE APPLICATION OF KIM EPPARD AND JASON <br />SEKANY FOR CONDITIONAL USE PERMIT APPROVAL, <br />AS FILED UNDER CASE PCUP-101 <br />WHEREAS, Kim Eppard and Jason Sekany have applied for a conditional use permit to <br />operate an indoor baseball pitching facility within an existing building located at <br />7070 Commerce Circle; and <br />WHEREAS, zoning for the property is I-G-40,000 (General Industrial) District; and <br />WHEREAS, at its duly noticed public hearing of December 10, 2003, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br />California Environmental Quality Act (CEQA); and <br />WHEREAS, the Planning Commission made the Following findings: <br />The proposed location of the conditional use is in accordance with the <br />objectives of the zoning ordinance and the purpose of the district in which <br />the site is located. <br />The objectives of the zoning ordinance include fostering a harmonious, <br />convenient, workable relationship among land uses; protecting existing land use <br />from inharmonious influences and harmful intrusions; and insuring that public <br />and private lands ultimately are used for the purposes which are most appropriate <br />and beneficial to the City as a whole. The proposed facility is an indoor <br />instructional baseball pitching facility to be used primarily by local elementary <br />and high school students. All activities associated with the use would be confined <br />inside the building. In the past, the City has approved similar uses which have <br />been operating in similar industrial parks with the same zoning designation <br />without any land use conflict with other businesses in the surrounding area. The <br />proposed indoor baseball pitching facility would be consistent with the <br />above-cited objectives. <br />The subject site is zoned I-G-40,000 (General Industrial) District, which has a mix <br />of light industrial/office/warehouse uses. As proposed, the operation of the <br />indoor baseball pitching facility would not interfere with the surrounding <br />
