PLANNING COMMISSION CITY OF PLEASANTON
ALAMEDA COUNTY, CALIFORNIA
RESOLUTION NO. PC-2003-52
RESOLUTION APPROVING THE APPLICATION OF KIM EPPARD AND JASON
SEKANY FOR CONDITIONAL USE PERMIT APPROVAL,
AS FILED UNDER CASE PCUP-101
WHEREAS, Kim Eppard and Jason Sekany have applied for a conditional use permit to
operate an indoor baseball pitching facility within an existing building located at
7070 Commerce Circle; and
WHEREAS, zoning for the property is I-G-40,000 (General Industrial) District; and
WHEREAS, at its duly noticed public hearing of December 10, 2003, the Planning
Commission considered all public testimony, relevant exhibits, and
recommendations of the City staff concerning this application; and
WHEREAS, projects of this nature are categorically exempt from the requirements of the
California Environmental Quality Act (CEQA); and
WHEREAS, the Planning Commission made the Following findings:
The proposed location of the conditional use is in accordance with the
objectives of the zoning ordinance and the purpose of the district in which
the site is located.
The objectives of the zoning ordinance include fostering a harmonious,
convenient, workable relationship among land uses; protecting existing land use
from inharmonious influences and harmful intrusions; and insuring that public
and private lands ultimately are used for the purposes which are most appropriate
and beneficial to the City as a whole. The proposed facility is an indoor
instructional baseball pitching facility to be used primarily by local elementary
and high school students. All activities associated with the use would be confined
inside the building. In the past, the City has approved similar uses which have
been operating in similar industrial parks with the same zoning designation
without any land use conflict with other businesses in the surrounding area. The
proposed indoor baseball pitching facility would be consistent with the
above-cited objectives.
The subject site is zoned I-G-40,000 (General Industrial) District, which has a mix
of light industrial/office/warehouse uses. As proposed, the operation of the
indoor baseball pitching facility would not interfere with the surrounding
