Resolution No. PC-2003-51 <br />Page 3 <br />Exhibit B <br />PUD-85-8-7D-1M <br />Conditions of Approval <br />November 12, 2003 <br />The demolition and building modifications to Building 2 shall be substantially as <br />shown on the development plans, Exhibit "A", dated "Received November 4, <br />2003" on file with the Planning Department, except as modified by the following <br />conditions. Minor changes to the plans may be allowed subject to the approval of <br />the Planning Director if found to be in substantial conformance to the approved <br />exhibits. <br />2. All conditions of PUD-85-8-7D shall remain in full force and effect, unless <br />superseded by the conditions of this application. <br />3. The project developer shall pay any and all fees to which the property may be <br />subject prior to issuance of building permits. The type and amount of the fees <br />shall be those in effect at the time the building permit is issued. <br />This design review approval will lapse within one (1) year from the date of <br />approval unless a building permit is issued and construction has commenced and <br />is diligently pursued toward completion or an extension has been approved by the <br />City. <br />This approval to demolish and modify a portion of Building 2 in no way provides <br />approval to demolish, construct, or reconstruct any other buildings at the site. The <br />developer understands that a separate approval is required for the construction of <br />the proposed Kohl's store at the current location of Building 1. In the event that <br />the proposed changes to Building 2 are completed and construction of the Kohl's <br />store is not begun within six months, the property owner shall be required to <br />provide to the Planning Director for review and approval, plans for an enhanced <br />treatment of the pad area of Building 2 with landscaping, hardscape, structure, or <br />other attractive means. <br />All conditions of approval for this case shall be written bV the project <br />developer on all building permit plan check sets submitted for review and <br />approval. These conditions of approval shall be on, at all times, all grading and <br />construction plans kept on the project site. It is the responsibility of the building <br />developer to ensure that the project contractor is aware of, and abides by, all <br />conditions of approval. Prior approval from the Planning Department must be <br />received before any changes are constituted in site design, grading, building <br />design, building colors or materials, etc. <br />The project developer shall effectively screen from view all ducts, meters, air <br />conditioning equipment, and any other mechanical equipment, whether on the <br />structure, on the ground, or on the roof, with materials architecturally compatible <br />with the main structure. Screening details shall be shown on the plans submitted <br />
