Resolution No. PC-2003-44 <br />Page 4 <br />The proposed "park-n-sell" car lot shall not be in operation when major <br />Bay Area events are scheduled on weekends and high BART rider ship <br />is expected. Prior to operation of the car lot, the applicant shall establish <br />a notification procedure with BART, and a copy of the notification shall <br />be reviewed and approved by the Planning Director. <br />All "park-n-sell" car lot users shall state in writing that vehicles brought <br />to the car lot for display and sale are not associated with any car <br />dealership. Prior to operation of the car lot, the applicant shall provide a <br />copy of the non-dealer representation to the Planning Department. <br />8. Prior to operation of the car lot, the applicant shall submit a copy of the <br />executed contract with the security company to the City. <br />9. No campers, RVs, and trailers, except for the operator's trailer, shall be <br />displayed on the proposed "park-n-sell" car lot. No overnight camping <br />shall be allowed, and the operator's trailer shall not be used for <br />overnight sleeping. <br />10. No inoperable vehicles or vehicles that have oil/fluid leakage problem <br />shall be displayed at the proposed park-n-sell car lot. If oil/fluid leakage <br />was discovered, the car lot operator shall be responsible for the cleanup. <br />Prior to operation of the car lot, the applicant shall provide a procedure <br />detailing methods and cleansers/chemicals that will be used to clean <br />oil/fluid leakage, and a procedure to prevent such substances from <br />entering the storm drain system, to the Planning Director for review and <br />approval. <br />11. Except for the signs that are printed on the canopy, no flag streamers, <br />portable signs, and/or other decoration or attention-getting device shall <br />be used on the subject site. <br />12. Prior to operation of the car lot, the applicant shall submit a site plan, <br />accurately showing the locations of construction cones and the location <br />of the car lot operator's trailer to the Planning Director for approval. <br />13. At all times the proposed "park-n-sell" car lot shall be kept in a litter <br />free condition. Prior to operation, the applicant shall provide <br />information on car lot maintenance and additional trash collection <br />services to the Planning Director for review and approval. The <br />applicant shall advise car lot users not to litter and shall place trash <br />receptacles in the car lot as needed. <br />
