14. This development plan shall be of no further validity and the project developer shall be <br />required to submit the same or new development plan for City approval prior to devel- <br />opment of the site in the event that the project developer fails to record a final map within <br />one year of the effective date of this approval. <br />Planning Requirements: <br />15. The siting of the building models covered by this approval shall implement the following <br />requirement: <br />a. No model type shall be used on fewer than four or more than eight of the medium <br />density residential lots, e.g., Lots 1 through 26. At least three of these models <br />shall be sited on the low-density residential lots, Lots 27 though 30. The final <br />house-plotting plan shall strive to avoid placing two of the same models adjacent <br />to each other, facing the same street. In the event that adjoining lots have the same <br />model, different elevations shall be used on these models. <br />b. The final building colors and materials shall be submitted for review and approval <br />by the Planning Director prior to the issuance of the first building permit for these <br />homes. <br />c. The final building elevations showing all window and trim detailing, shall be re- <br />viewed and approved by the Planning Director prior to issuance of the first build- <br />ing permit. <br />16. Prior to the demolition of any existing structure(s) located on the subject property, the <br />project developer shall have the structures examined for the presence of lead, lead-based <br />paint, and/or asbestos by a qualified environmental professional. If lead and/or asbestos <br />are found to be present, demolition of these structures shall be conducted in accordance <br />with the applicable requirements of the California Department of Industrial Relations <br />(Cal-OSHA) for lead, and Cal OSHA and the Bay Area Air Quality Management Board <br />(BAAQMD for asbestos. The project developer shall provide to the Planning Director a <br />follow-up report within 30-days after demolition of the structure(s) is completed. <br />17. Prior to the demolition of any existing structure(s) located on the subject property, the <br />project developer shall have the structure(s) examined for the presence of bats. <br />18. The project developer shall pay one-half of the non-school funded (reimbursed by the <br />State of California) cost of the loop road, which is located on the west, south, and east <br />sides of the adjoining public school. If this project developer constructs the entire loop <br />road first, the project developer shall be eligible for reimbursement for the portions of <br />road not their responsibility. <br />PUD-Ol-3M, PC Conditions Page 5 of 26 September 24, 2003 <br />
