40. On Lots 1 through 32 and Parcel "B", the recorded deed of sale for all these lots shall in- <br />clude the following statement to be signed by the future homeowner stating that: <br />"You are hereby advised that this property is located near land zoned and/or <br />used for agricultural purposes. Agricultural use is defined as including but <br />not limited to day and night-time activity relating to livestock grazing, the <br />keeping of livestock, the growing and processing of agricultural crops, and <br />any commercial agricultural practices performed as incidental to or in con- <br />junction with such operations. Some of the impacts associated with agricul- <br />tural use include but are not limited to noise, odor, dust, chemicals, refuse, <br />waste, unsightliness, use of agricultural equipment, and traffic. Permitted ag- <br />ricultural pursuits conducted in accordance with good practice and mainte- <br />nance are not deemed by the City of Pleasanton to be a nuisance." <br />41. With recordation of the first final map covering Lots 1 through 30, and Parcel "B", the <br />project developer shall pay to the City of Pleasanton fees for City distribution to the <br />South Livermore Valley Agricultural Land Trust. The fees would be calculated based on <br />a one-to-one ratio between the cost per acre for agricultural easements to the Land Trust <br />and the net acreage of potentially cultivable soils located on lands having less than a 25% <br />slope grade. <br />Building and Site Design Requirements: <br />42. The project developer shall provide automatic opening sectional roll-up garage doors <br />throughout the project, as approved by the Director of Building Inspection and Planning <br />Director. <br />43. The project developer shall use their best efforts to implement the measures identified in <br />the "Hahner Project New Home Green Building Checklist" in the design, construction, <br />and operation of the proposed homes. Before issuance of a building permit, the green <br />building measures and their point totals shall be explicitly called out on a separate sheet <br />of the building permit plan set and shall be subject to review by the Planning Director. <br />The green building measures shall total 50 points. Otherwise, further measures shall be <br />required by the Planning Director to reach that goal. <br />44. Private yazd lighting shall be designed, installed, and controlled so as not to be pointed <br />directly towazds the existing and future "uphill" properties located along the south side of <br />Old Vineyazd Road. <br />45. The project developer shall post address numerals on the building so as to be plainly visi- <br />ble from all adjoining streets or driveways during both daylight and night time hours. <br />46.
