PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. PC-2003-42 <br />RESOLUTION RECOMMENDING APPROVAL OF THE APPLICATION OF <br />MARDEL, LLC FOR A MAJOR MODIFICATION TO AN PUD <br />DEVELOPMENT PLAN, AS FILED UNDER CASE PUD-OI-3M <br />WHEREAS, Mardel, LLC has applied for a major modification to an approved PUD <br />development plan to modify the building designs, update the green <br />building measures, and to allow maintenance of common areas by a <br />maintenance association fora 30-unit, single-family residential <br />development with one existing home and one vineyard parcel located at <br />2287 Vineyard Avenue; and <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - <br />LDR/MDR/OS/Vineyard (Low Density Residential/Medium Density <br />Residential/Open Space/Vineyard) District; and <br />WHEREAS, at its duly noticed public hearing of September 24, 2003, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, an Environmental Impact Report (EIR) was prepared and certified for the <br />Vineyard Avenue Corridor Specific Plan; and <br />WHEREAS, there are no substantial changes to the project or to the circumstances <br />under which the project is undertaken that involve new significant <br />environmental effects or substantially increase the severity of previously <br />identified effects, and there is no new information of substantial <br />importance not known at the time the EIR was certified regarding the <br />project or its effects, mitigation measures, or alternatives; therefore, no <br />additional environmental documentation was prepared for this application; <br />and <br />WHEREAS, the Planning Commission determined that the proposed modification <br />substantially conforms to PUD-O1. <br />
