PLANNING COMMISSION CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION N0. PC-2003-41 <br />RESOLUTION APPROVING THE APPLICATION OF BRETT ALAN <br />GREGORY FOR CONDITIONAL USE PERMIT APPROVAL, AS FILED <br />UNDER CASE PCUP-94 <br />WHEREAS, Brett Alan Gregory has applied for conditional use permit approval to <br />operate a guitar instruction business in an existing building located at 4625 <br />First Street, Suite 140; and <br />WHEREAS, zoning for the property is PUD-C-O (Planned Unit Development - <br />Commercial-Office) and Downtown Revitalization District; and <br />WHEREAS, at its duly noticed public heazing of September 24, 2003, the Planning <br />Commission considered all public testimony, relevant exhibits, and <br />recommendations of the City staff concerning this application; and <br />WHEREAS, projects of this nature are categorically exempt from the requirements of <br />the California Environmental Quality Act (CEQA); and <br />WHEREAS, the Planning Commission made the following findings: <br />The proposed location of the conditional use is in accordance with <br />the objectives of the zoning ordinance and the purpose of the <br />district in which the site is located. <br />The proposed guitar studio provides one-on-one indoor instruction lessons <br />in an enclosed area. In the past, the City has allowed a similaz use to be <br />located in the vicinity. The operation of the proposed guitar studio would <br />not interfere with surrounding businesses' ability to operate. The <br />anticipated noise level is well within the limitation of the Noise <br />Ordinance. <br />2. The proposed location of the conditional use and the conditions <br />under which it would be operated or maintained will not be <br />detrimental to the public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the vicinity. <br />Based on the proposal for the proposed guitar studio, its operation would <br />be compatible with other uses in the same zoning district. The subject <br />studio is located in the rear of the building, facing the parking lots and <br />other commercial buildings. Its operation should not impact the <br />residential neighborhood that is located on the opposite side of the <br />building, across First Street. <br />
