Resolution No. PC-2003-39 <br />Page 4 <br />Exhibit B <br />Conditions of Approval <br />Case PCUP-92 <br />The operation of the proposed use shall conform substantially to Exhibit A (dated <br />"Received" July 7, August 5, and August 15, 2003), on file with the Planning <br />Department, except as modified by these conditions. Minor modifications to the <br />operation of the use and conditions of approval may be approved by the Planning <br />Director if determined to be in substantial conformance with the approved use <br />permit. <br />2. The operation of the restaurant/bar shall be limited to the following hours: 7:00 <br />a.m. to 1:00 a.m., Monday through Saturday, and 8:00 a.m. to midnight on <br />Sundays. The outdoor dining on the south side of the building shall close and not <br />be used after 10:00 p.m. The restaurant/bar employees shall not dispose of waste <br />or recyclables or clean mats or containers in the trash enclosure area prior to 8:00 <br />a.m. or after 8:00 p.m. <br />3. In the event that the applicant proposes to modify the hours or other aspects of the <br />restaurant/bar operation, the modification shall be subject to the review of the <br />Planning Director. The Planning Director may approve the modification or refer <br />the matter to the Planning Commission if judged to be substantial. <br />4. The applicant shall maintain the area surrounding the restaurant/bar, outdoor <br />dining areas, and parking lot in a clean and orderly manner at all times. The <br />applicant shall monitor the area outside of the restaurant/bar to ensure peace and <br />quiet. <br />If operation of this use results in conflicts pertaining to parking, interior or <br />exterior noise, traffic/circulation, litter, odors, loitering, fighting, or other factors, <br />at the discretion on the Planning Director, this conditional use permit may be <br />submitted to the Planning Commission for their subsequent review at a public <br />hearing. If necessary, the Commission may modify or add conditions of approval <br />to mitigate such impacts, or may revoke said conditional use permit. Possible <br />mitigation measures can include, but are not limited to: reducing the number of <br />seats and/or tables, restricting the hours of operation, adding soundproofing, <br />hiring security personnel, installing odor mitigating devices, and/or prohibiting <br />alcohol consumption in the outdoor dining areas. <br />6. The subject conditional use permit shall be reviewed by the Planning Director in <br />six months to determine if the business is operating in anon-nuisance manner. if <br />necessary, the conditional use permit may be brought back to the Planning <br />Commission for additional conditions to mitigate and/or prevent any nuisances <br />that were identified. <br />
